The Texas Public Information Act (the “Act”) was adopted in 1973. The purpose of the Act is to maintain the people's control “over the instruments they have created,” and requires that information in the possession of a governmental body be generally available to the public. Often a governmental body will possess information involving a third party; such information could be subject to disclosure under the Act. The purpose of this article is to lay out the procedures and requirements of the Act, focusing on the Act's implications for third parties, and to offer suggestions for practices that parties who must submit information to governmental bodies can follow to help avoid disclosure of sensitive information.
