Legal
Advice: Personal Injury Claims
and
Compensation Cases
It is a good idea to
wait a sufficient length of time ...
before settling and forever releasing all rights to the claim.
In a situation where a person has suffered only minor
temporary injuries and incurred medical bills of a few hundred dollars, there is probably
no need to involve an attorney. However, even in those situations, it is a good idea to
wait a sufficient length of time to make sure that the personal injury is, in fact, minor
and temporary before settling and forever releasing all rights to any personal injury
settlements.
Insurance adjusters
many times will go to great lengths to keep an injured victim from hiring an attorney to
represent them.
However, where a more serious and/or permanent injury has
been sustained, an individual who does not have the training and experience in these
situations, is not on an even playing field with the claims representative and/or defense attorneys.
Claim reps
have specialized training, experience, and are closely supervised to operate within strict
insurance company guidelines. Nonetheless, insurance adjusters many times will go to great
lengths to keep an injured victim from hiring an attorney to represent them.
In today's environment of much negative
publicity about phony medical cases, insurance companies and Defendants generally
fight cases and do not make quick, easy compensation, except in very small cases That may
not have always been the case, but that is certainly the current state of affairs. As is
also often the case, free advice from family and friends on a claim is easy to come
by. However, as is true with most things in life, these cases can be a lot more
complicated than they may appear on the surface.
For example, it is critical to sort out and identify all
potentially liable parties at an early stage in a case. While the general two year Statute
of Limitations that applies to most claims of this type in Illinois may seem like a
long time, often the only way to develop the information necessary to identify all proper
Defendants in a case is to file suit and utilize Court procedures to obtain information
and documents. Remember, the Defendants are typically not going to cooperate in
volunteering this information.
