1. Copyright
1.1 The Financial Services Authority owns the copyright and any other rights in all material on this site other than any Parliamentary material, third party stock images (such as photographs) and other material as indicated.
1.2 Subject to Clauses 5 and 6 below (special conditions applying to the Comparative Tables and Industry Training sections of the FSA website) you may print and download extracts from this site on the following conditions:
1.2.1 the documents and related graphics on this site are for personal use or for use within an individual firm or organisation; any copies of these pages that you save to disk or to any other storage medium may (subject to the exception referred to at 1.2.4 below) only be used for subsequent personal viewing purposes of for viewing within the firm or organisation by which they were saved or stored;
1.2.2 any extracts which are printed may only be used for personal viewing - or for viewing within the firm or organisation by which they were printed (subject only to the exception referred to at 1.2.4 below);

1.5 The Parliamentary copyright material on this website, relating to the legislative history of the Financial Services and Markets Act, is reproduced with the permission of the Controller of Her Majesty's Stationery Office on behalf of Parliament.
1.6 Photographs of senior staff of the FSA ("the Executive Photographs") are made available on this site and may be reproduced under the following licence on the terms specified.
1.6.1 The FSA grants this licence to firms and other readers, including journalists. Any of the Executive Photographs may be reproduced in any publication, whether or not sold or otherwise circulated for profit, on the following terms and conditions.
1.6.2 No photograph is to be modified in any way;

3.1 We try to ensure that the information on this site is correct, but we do not give any express or implied warranty as to its accuracy. We do not accept any liability for error or omission.
3.2 The definitive version of an FSA publication other than the Handbook is the original, printed one. The definitive version of Handbook text at any particular time is the version contained in the instruments (including amending instruments) published on the FSA website.
3.3 We are not liable for any damages (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from the use of or inability to use this site, or any material contained in it, or from any action or decision taken as a result of using this site or any such material.
3.4 Part of this site contains material sent to us by third parties. 4.1 By accessing any part of this site, you will be deemed to have accepted these terms in full.
4.2 These terms are governed by and interpreted in line with English Law.
5. Special additional terms and conditions applying to the Comparative Tables section of the FSA website.
5.1 You can print and download extracts from the Comparative Tables section of the FSA website on the following conditions. These apply in addition to, or (where indicated) in place of, the other conditions specified in this section headed Legal Information.
5.2 If you intend to publish material from this site, to use it in promotions, advertising or product literature or in some other form in the public domain, then you must comply with the following terms.
5.2.1. Our copyright notice (i.e. © The Financial Services Authority) must appear in all copies.
5.2.2. The date that we last updated the information (as indicated on the website) must be stated clearly on all copies, with the website address (www.fsa.gov.uk/tables); for example "Information taken from the FSA's Comparative Tables (www.fsa.gov.uk/tables) as at [date]".
5.2.3. The publication must not imply FSA endorsement of any company or product or of any conclusions drawn from the data.
5.2.4. Any tables must either:
- be presented complete and with no additions; or
- if one or more tables is not complete, state that the information is based on a limited selection taken from the tables prepared by the FSA; for example "Selected from a total of [total number of products shown on website or printed table] products".
5.2.5. If you include additional data, you must distinguish it from the data provided by FSA and clearly identify its source.
5.2.6. If you present our data in non-alphabetical order, you must make clear the basis for the way you have ordered it and must not indicate or imply any FSA endorsement of the ordering.
5.3 Information from this site is freely available for research. However, if you use or quote this material to a client in connection with a financial product or service, then - in addition to complying with the conditions in 5.2 above - you must give the client a print of the appropriate table. This should be:
5.3.1. as filtered and sorted by you;
5.3.2. complete in that it should include all products that remain after filtering, not just any you have shortlisted;
5.3.3. accompanied by the supporting introduction and column explanation pages;
5.3.4. as created using the print function on this site, without amendment.
6 Special additional terms and conditions applying to the Industry Training section of the FSA website
6.1 Status of training material: The information on the Industry Training website and entered in its tutorials does not have the status of guidance in the FSA Handbook. This information contains descriptions of the rules and guidance in the FSA Handbook solely as an educational tool and not as an aid to Interpretation. To the extent that there is any discrepancy between this information on the Industry Training website, or in Industry Training tutorials, and the FSA Handbook, the Handbook prevails.
6.2 Copyright: This material, in whole or in part, may only be reproduced, stored, transmitted in any form by any means, or used by more than one specified individual, with the prior written permission of the FSA.
6.3 Passwords and Security: You are responsible for maintaining the confidentiality of any password(s) you are given to access the Site, and are fully responsible for all activities that occur under your password(s). You agree to notify malcolm.easton@fsa.gov.uk immediately of any unauthorised use of your password(s). FSA Industry Training is concerned about the security of personal information collected from you and has taken reasonable steps to prevent unauthorised access to that information. (See Privacy Policy, Clause 6.5, below.)
6.4 Changes to the site: Industry Training reserves the right to make changes or updates to the Site at any time without notice.
6.5 Privacy Policy:
6.5.1 The following statement explains the FSA’s policy regarding the Personal Information we collect about you. Industry Training aggressively protects information on our site or submitted to it. Your privacy is of utmost concern to us.
6.5.2 Statement of Intent: When registering for a course and at some other times, you will be asked to submit personal information about yourself (e.g. your name, company name, address and email address, etc.) in order to receive or use the services on our Web Site.
By entering your details in the fields requested, Industry Training will be able to provide you with the services you select. Your information will be held securely on our servers. Industry Training reserves the right to perform statistical analyses of user behaviour and characteristics so that Industry Training can improve its training modules and facilities. Industry Training will act in accordance with current legislation and meet current Internet best practice on gathering personal information.
6.5.3 Information on Visitors: Before the course is taken something called a cookie is downloaded to your computer’s hard drive. A cookie is a small data file that identifies the computer to Industry Training’s servers. This increases the functionality of the course and enables us to provide a better service. For example, when a registered user returns to the training Site the cookie file helps the server navigate to the point at which the registered user left the course so the user can continue from where they left off. Many sites do this whenever a user visits their site in order to track traffic flows, observe behaviour and compile aggregate information to improve future use. Cookies do not attach to your system or damage your files.You have the opportunity to set your computers to accept all cookies, to notify you when a cookie is issued, or not to receive cookies at any time. If you set your internet browser so that it will not allow cookies to be stored on your computer’s hard drive the functionality of this site is likely to be reduced and certain functions and features will not be available.
6.5.4 Personal Information: When you supply any personal information Industry Training has legal obligations towards you in the way we deal with that data. Our policy is to hold the data we receive in accordance with the Data Protection Act 1998.
We undertake to collect and process the information fairly, and make sure the personal information held is relevant, up to date and accurate. We will hold it securely and we will not pass it on to anyone else. We will hold the information while you use the training packages and for a reasonable period thereafter. You may request that your details are removed from our records at any time after you have ceased to use the training packages.
6.5.5 Your Personal Information: You have the right to request a copy of the personal information that Industry Training holds about you and to have any inaccuracies corrected. These requests should be sent to the FSA’s Data Protection Team (Data.Protection@fsa.gov.uk). A nominal charge is made for information requests. Freedom of Information requests should also be directed to the Data Protection Officer together with any charges as appropriate.
6.5.6 Targeted Marketing and Other Uses: As more and more facilities become available on the Industry Training Web Site and its host site, the Financial Services Authority Web Site (fsa.gov.uk), Industry Training might use your personal information to inform you of any facilities which could be of further interest to you, e.g. further course modules related to the course you have previously signed-up for. You will be given the opportunity not to receive this information. You can request Industry Training to remove your name from the database at any time by contacting malcolm.easton@fsa.gov.uk . The e-mail should be sent under the subject title ‘Remove my name and details’.
Industry Training reserves the right, at any time, to modify, alter, or update this privacy policy and any changes shall be notified to all users.
6.6 Conflicts in and changes to these terms: Industry Training reserves the right, at any time and in its sole discretion, to modify the “Terms of use” (including those relating to your use of the Content). When terms are changed, Industry Training will publish details of those changes by including them at the end of these Terms of use (see Details of changes, Clause 6.7). Therefore you should review this page from time to time so that you will be aware of any such modifications. If you use the Site after Industry Training has published any changes, you are then agreeing to be bound by those changes. If you do not wish to be bound by those changes, you should cease to use this Site.
Areas of the Site may have different terms of use posted. If there is a conflict between the Terms of use and those posted for a specific area of the Site, the latter shall have precedence with a respect to your use of that area of the Site.
