auDA is aware that DNA has sent another mail out to businesses, schools, government agencies, non-profit organisations and individuals in Australia, with the heading "Internet Name Currently Unregistered".
auDA is continuing to pursue representative proceedings (class action) against DNA. Please click here for more information.
The ACCC also initiated proceedings against DNA on 2 October 2003. Please see the ACCC media release for more information.
As part of the proceedings that auDA has issued against DNA, we applied for an interlocutory (or temporary) injunction restraining DNA from using the funds they receive as a result of the mail out. The application was heard on 25 August 2003 before Justice Finkelstein but was unsuccessful. A copy of the Orders and Ruling is available here.
auDA has won its TPA action against Domain Names Australia Pty Ltd, over mass mail outs during 2003.
auDA cautions that registering multiple domain names for the primary purpose of capturing web traffic and/or selling click-through advertising may result in cancellation of the domain names for breach of policy.
