Overview
The scope of our commercial litigation practice reflects the wide range of business activities in which our clients engage.  Clients include a number of major energy companies, petrochemical companies, national real estate concerns, high technology companies, major law, accounting, and engineering firms, a large consumer finance company, various individuals, hospitals and other major medical institutions, several large banks, officers and directors of public corporations, and national securities brokerage and investment banking firms.  We handle the full range of commercial disputes, including:
  • general contract disputes
  • disputes between sellers and buyers of goods
  • disputes between co-owners of businesses
  • business torts, such as tortious interference, fraud, misrepresentation, misappropriation of trade secrets, and unfair competition
  • statutory claims, such as antitrust, civil RICO, and DTPA
  • disputes arising out of acquisitions and divestiturers

We are experienced, tenacious trial lawyers, with a long history of prevailing in state and federal courts, arbitrations, and ADR proceedings.  Partnering with our clients, we use the latest technologies to prepare our cases in the most cost-effective manner and to make compelling presentations of even the most complex subjects.  The following is a representative sampling of some of the matters we are proud to have recently handled on behalf of our clients:

  • Secured in a contingent fee representation $1.035 billion antitrust judgment on behalf of ETSI Pipeline, with a net amount of $425 million ultimately received by our client in pre-trial and post-judgment settlements
  • Obtained a take-nothing award in the arbitration of a $300 million preferential purchase rights claim against The B.F. Goodrich Company
  • Obtained a $20 million judgment for an oilfield service company based on claims of breach of contract and fraud
  • Successfully defended a client in a breach of contract and securities fraud case that settled very favorably for our client after the trial resulted in a hung jury
  • Obtained a take-nothing award in a AAA International arbitration of a $1.3 billion claim arising out of the ownership and operation of an international gas and power trading and marketing company
  • Obtained defense award for investment banking firm in a AAA arbitration involving $30 million securities fraud claim
  • Obtained a $211.2 million jury verdict and judgment in state court on behalf of David’s Supermarkets against a large grocery wholesaler that the jury found had engaged in malicious fraud and knowing deceptive trade practices (the case subsequently settled for a substantial sum)
  • Obtained a $28 million judgment for an oil and gas exploration company on a claim for breach of contract
  • Represented Lloyd’s of London and other international insurers in state court trial of $850 million in insurance coverage claims arising out of the EXXON VALDEZ oil spill
