Pelco Usage Policy

Policy Regarding Use of Pelco Name, Logos, Product Images, and Related Materials

Pelco is pleased to allow its customers the use of Pelco’s name and trademarks for the purpose of properly promoting sales of its products and strengthening the relationship with its customers. This policy is intended to define the legal terms under which Pelco is willing to allow use of this property by outside companies.

Use of the PELCO name, Logos, product images, and related information (in print- and/or electronic-forms) (hereinafter "PELCO Property") is limited to Pelco-Authorized Dealers, Authorized Distributors, Authorized Systems Integrators, and Sales Representatives (hereinafter "User"). An "Authorized Dealer" is defined as a company that purchases a minimum of US $5,000 per year of Pelco products directly from Pelco or through one of its Authorized Distributors, and resells Pelco products to end-users. An "Authorized Distributor" is defined as a company that has a VPD agreement in effect directly with Pelco that stocks and resells Pelco products to Dealers. An "Authorized Systems Integrator" is defined as an Authorized Dealer with engineering capability that designs and installs integrated systems using Pelco products. Companies are specifically prohibited from using the terms "Authorized Dealer", "Authorized Distributor", or "Authorized Systems Integrator", unless they meet the specific qualifications described herein.

Pelco grants User permission to use the PELCO Property subject to the following conditions: (1) all advertising of User clearly indicates that it is advertising of User, and is not advertising of Pelco; (2) User's advertising does not imply or suggest an association between User and Pelco other than that of buyer and seller; (3) User's use of the Pelco Property positively represents Pelco and Pelco CCTV equipment and related services in a professional manner; (4) User's trade name is more predominant on User's advertising than PELCO trademarks; (5) the appropriate trademark notice ( ™ or ® ) appears adjacent all Pelco federally registered trademarks; (6) the Trademark Statement below appears in or at the end of all advertising wherein any Pelco trademarks are used; (7) no modifications of any Pelco Property are made; and (8) only Pelco MSRP product pricing may be used for direct marketing or E-commerce promotion activities. Use for any other purpose is expressly prohibited, and may result in severe civil and criminal liabilities.

The use of Pelco Property is authorized ONLY for promotion and sale of Pelco products. Use of Pelco Property DOES NOT imply any business association with Pelco, other than that of buyer and seller.

Pelco reserves the right to review User's advertising and may: (1) specify and require changes to the advertising as a condition of use; or (2) refuse or revoke permission to use Pelco Property by User.

Pelco trademarks are to be used in association with Pelco products according to the terms and conditions stated above. When Pelco trademarks are used for the purpose of demonstrating an association between another company and Pelco, permission is granted for their use provided that: (1) User is qualified as either an Authorized Dealer, Authorized Distributor, or Authorized Systems Integrator as defined above; (2) the applicable legend, "Authorized Pelco Dealer, "Authorized Pelco Distributor", or "Authorized Pelco Systems Integrator" appears below User's tradename; and (3) Pelco has not specifically denied permission to User. Pelco trademarks may not be used in any way that gives the impression that User is part of Pelco, or is the EXCLUSIVE Agent, Dealer, or Distributor for Pelco.

Permission to use Pelco Property for any other purpose is not granted, and must be specifically obtained in writing from the Pelco Marketing Department.

Pelco reserves the right to deny or revoke permission to use any of the Pelco Property for any or no reason at any time.

PELCO, the PELCO Logos, PELCOVISION, PELCOEUROPE, PELCO UK, COAXITRON, LEGACY, INTERCEPT, INTER-CHECK, IMAGEPAK, SYSTEM 9740, SYSTEM 9750, SYSTEM 9760, B.O.S.S., REDILINK, SPECTRA, ESPRIT, THE TRUE IMAGE OF SECURITY TECHNOLOGY, THE TRUE IMAGE OF EXCELLENCE, ACTIVEIMAGE, GENEX, DOMEPAK, PELCONET, SPECTRA II, SPECTRA LITE, and CAMCLOSURE, are either trademarks or federally registered trademarks of Pelco.

Any rights not expressly granted herein are reserved.

Trademark Statement
The following Trademark Statement must appear on any document that contains a Pelco trademark:

"[the appropriate Pelco trademark(s)] is a (are) trademark(s) of Pelco - Clovis, CA, and may be registered in certain jurisdictions."

Notice Specific to Software Available On This Website
Any software ("Software") that is made available to download from this server ("Server") is the copyrighted work of Pelco and/or its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software ("License Agreement").

End users are expressly prohibited from installing any Software that is accompanied by or includes a License Agreement, unless the user first agrees to the License Agreement terms. The Software is made available for downloading solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED. THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT. EXCEPT AS WARRANTED IN THE LICENSE AGREEMENT, PELCO HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE SOFTWARE, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

The use of Pelco Software is authorized ONLY for promotion and sale of Pelco products. Use of Pelco Software DOES NOT imply any business association with Pelco, other than that of a Pelco Distributorship agreement.
