Summaries of Transportation-related Acts and Regulations

B.C. Rail Benefits (First Nations) Trust Act

Creates the BC Rail Benefits (First Nations) Trust and authorizes that corporation to receive funds out of proceeds realized from the disposition of shares and assets of the British Columbia Railway Company. The funds will be available for First Nations’ projects that advance economic development, education advancement and cultural renewal.

British Columbia Railway Act

Establishes the British Columbia Railway Company, establishes a board of directors and sets out the reporting and institutional relationships with the provincial government.

British Columbia Transit Act

Establishes the British Columbia Transit Authority, establishes a board of directors and sets out the reporting and institutional relationships with the provincial government.

Coastal Ferry Act

Enables BC Ferries to be established as an independent commercial company under the Company Act. The act provides for a long-term service contract between the province and BC Ferry Services. The act also creates the BC Ferry Authority which governs the company.

Commercial Transport Act

Shared among the Minister of Transportation, the Minister Responsible for ICBC and the Minister of Public Safety and Solicitor General. The act establishes the licensing requirements for commercial vehicles, as well as commercial vehicle configuration and safety standards. The Minister of Transportation is responsible for section provisions as they relate to highway infrastructure, and weigh scales and Commercial Vehicle Safety Enforcement.

Greater Vancouver Transportation Authority Act

Establishes the Authority (TransLink), sets out a board of directors and provides for funding mechanisms, powers and authorities.

Industrial Roads Act

In combination with other acts, governs the operation of industrial roads, including the drivers and vehicles that use these roads.

Land Title Act – (section 77.2 only)

This section provides authority for the Lieutenant Governor in Council to appoint approving officers for rural areas of the province. The subdivision approving function is carried out by employees of the Ministry of Transportation who are given this designation by Order in Council.

Motor Vehicle Act

Shared among the Minister of Transportation, the Minister Responsible for ICBC and the Minister of Public Safety and Solicitor General. The Minister of Transportation is responsible for those sections that set out the rules of the road, traffic control device standards, commercial vehicle weigh scales and vehicle safety standards and inspections. The Minister Responsible for ICBC is responsible for the sections on vehicle and driver licensing and driver training. The Minister of Public Safety is responsible for those sections relating to the Office of the Superintendent of Motor Vehicles.

Passenger Transportation Act

Regulates the licensing of commercial passenger vehicles. Vehicles are defined as inter-city buses, passenger directed vehicles (i.e., taxis and limousines) or general passenger vehicles (i.e., sightseeing buses and shuttles). The act establishes the economic entry and safety criteria based on these different vehicle types.

Railway Act

Sets out matters relating to the establishment and corporate governance of railways operating solely within the province and falling under provincial jurisdiction, excluding recreational railways

Railway Safety Act

Harmonizes railway safety regulation in B.C. with federal regulations by enabling the adoption of federal railway safety standards, allowing delegation of administration of the Act to the federal government and the BC Safety Authority, and enables the adoption of provisions of the Railway Safety Act (Canada) regarding safety inspectors so that railway safety inspectors in B.C. have the same authority as held by their federal counterparts.

Significant Projects Streamlining Act

Fosters economic development by allowing the timely implementation of major economic development projects.

Transportation Act

Deals with the planning, design, holding, construction, use, operation, alteration, maintenance, repair, rehabilitation and closing of provincial highways and public works related to transportation. The act also authorizes the collection of tolls for the Coquihalla Highway and inland ferry administration.

Transport of Dangerous Goods Act

Sets out the regulations and standards for the movement of dangerous goods by truck within the province.

Transportation Investment Act

Provides a framework for developing public-private partnerships, known as P3s, to expand and improve provincial transportation infrastructure.
