Legislation & Bye-Laws for Ireland's Shannon Region to 2007

There are a myriad of Fisheries Bye laws under the Fisheries Acts which are in many cases specific to a particular fishery. These are listed where relevant on a fishery by fishery basis in our Fishing Guides Angling sections. For details of the Fisheries Acts see

The following is an overview of the important Angling Regulations/Bye Laws which cover fishing in the Shannon region and nationally. For others, please check with us.  

GENERAL FRESHWATER BYE LAWS

  • The only legal method to catch freshwater fish is by rod and line (Bye-law No.595)

  • A person may fish with not more than two rods at any time (Bye-law No.595)

  • It is illegal to transfer live roach from one water to any other waters. (Bye-law No.561)

  • It is prohibited to kill more than 1 pike in any one day. (Bye-law No.809, 2006)

  • A person shall not take and kill by any means more than 4 coarse fish on any one day (Bye-law No.806, 2006)

In August 2006, the Department of Communications, Marine and Natural Resources introduced Bye Laws No: 806 and 809 covering Coarse and Pike fishing respectively.

In the Coarse Angling Bye-law, "coarse fish" means any fresh water fish other than pike, salmon, trout, eels or minnow. Copies of these Bye-laws will be available in different languages very soon.

CONSERVATION OF PIKE  BYE-LAW NO. 809, 2006  This links to a Microsoft Word Document

    The new pike bye-law (bye-law 809) provides for:

    • A bag limit of one pike in any one day

    • A ban on the killing of any pike greater than 50cm in length

    • A ban on the possession of more than one pike less than 50cm in length or more than .75kg of pike flesh. This provision does not apply to anyone storing pike or pike parts subject to conditions

    • A ban on the possession of more than 12 coarse fish for use as bait subject to conditions.

    CONSERVATION OF AND PROHIBITION ON SALE OF COARSE FISH BYE-LAW NO.  806, 2006  This links to a Microsoft Word Document

    • A person shall not take and kill by any means more than 4 coarse fish on any one day.

    • A person shall not take or kill by any means any coarse fish greater than 25 cm in length measured in a straight line from the tip of the snout to the fork of the tail

    • Any coarse fish taken inadvertently in contravention of this Bye-law must be handled carefully and returned without avoidable injury to the waters from which they have been taken

    • it is prohibited for any person, other than in the Louth Area or Moville Area, to sell or offer for sale any coarse fish caught by any means.

    • "Louth Area" has the meaning assigned to it by section 31 of the British - Irish Agreement Act 1999 (No. 1 of 1999)

    • "Moville Area" has the meaning assigned to it by section to it by section 2 of the Foyle Fisheries Act 1952 (No.5 of 1952)

    • it is prohibited to use or attempt to use live fish as bait in fishing in fresh water

    • it is prohibited to transfer for any purpose live roach (Rutilus rutilus) from any waters to any other waters

    • it is prohibited to fish for coarse fish by any means whatsoever other than by rod and line

    • A person may not attempt to fish for coarse fish in freshwater with more than two (2) rods at any one time.

      OTHER ANGLING  BYE LAWS & STATUTORY INSTRUMENTS  APPLICABLE FOR 2007

      These Bye Laws cover the most recent introductions as conservation measures to protect our fish life and aquatic habitats. Others are available on request.

      A new suite of  Wild Salmon conservation measures have been introduced by the Government to help the restoration of Salmon stocks. This includes the closure of certain rivers to angling for Salmon and Sea Trout where they fail to meet their conservation limit.

      Within the waters of the Shannon Fisheries Region, ONLY the RIVERS FEALE AND MULCAIR are open to Salmon angling and they are subject to quotas. The open season on these rivers are March 1st to September 30th. A bag limit also applies see Bye Law 816 below in respect of the River Feale and Bye Law 814. 

      IMPORTANT ADDITIONAL INFORMATION FOR ANGLERS - BROWN TAGS 

      From May 13th, 2007 the Minister introduced a system of Brown Gill tags for certain rivers where it is considered necessary in the interests of conserving stocks to closely monitor angling quotas to ensure river based quotas are not exceeded. The River Mulcair in Co Limerick is covered by this scheme.

      CONSERVATION OF SALMON AND SEA TROUT BYE LAW NO 818, 2007 This links to a Microsoft Word Document

      This Bye-law provides for catch and release in respect of salmon and sea trout (over 40 cm) in the portion of the Lower Shannon from O’ Briens Bridge downstream to the Blackbridge. The Bye-law also prohibits the use of fish hooks other than barbless hooks and worms as bait.

      CONSERVATION OF SALMON AND SEA TROUT BYE LAW NO. 820, 2007  This links to a Microsoft Word Document

      This Bye-Law prohibits the use of any fish hooks other than single barbless hooks and imposes a ban on the use of worms as bait in angling for salmon and sea trout over 40 cm once the annual bag limit has been reached.   The Bye-law also incorporates the provisions of the existing bag limit Bye-law No. 814, 2006 i.e.  a season bag limit of 1 fish in the period 1 Jan to 12 May, a daily bag limit of 3 fish from 13 May to 31 August and a daily bag limit of 1 fish from 1 September to the end of the season

      This Bye Law sets out the opening and closing dates (and hours) for the draft net salmon and trout (salmon includes sea trout as defined in the Fisheries Consolidation Act 1959) commercial fishing season and prohibits draft net fishing for (salmon and sea trout) in all districts other than those rivers mentioned in schedule 8 of the Wild Salmon and Sea Trout Tagging Scheme Regulation (S.I. No. 672, 2006). The Bye Law also prohibits the use of monofilament material in draft nets with the exception of Cork Harbour where monofilament material in draft nets is permitted.

      SHANNON FISHERIES REGION - CONSERVATION OF SALMON AND TROUT BYE LAW 817, 2007  This links to a Microsoft Word Document

      This Bye-law prescribes the minimum size of trout at 35 cm which may be taken from Lough Derg south or downstream of the bridge at Portumna and prohibits angling for trout during the period 1 October each year to 14 March in the next following year.  The Bye-law also provides for a minimum size of trout at 25 cm which may be taken in the waters of the tributaries of Lough Derg and incorporates the provisions of the Limerick District Bye-law Nos. 614, 1980 and 488, 1954. 

      SHANNON FISHERIES REGION (River Feale) CONSERVATION OF SALMON AND SEA TROUT BYE LAW NO 816, 2007  This links to a Microsoft Word Document

      This Bye-Law provides for a bag limit of 4 fish (being either salmon or sea trout over 40 cm) from 1 March to 12 May subject to a daily bag limit of 1 fish during the period.  The Bye-law also incorporates the provisions of the existing Bye-law i.e. an overall annual bag limit of 10 fish for 2007, a daily bag limit of 3 fish from 13 May to 31 August and a daily bag limit of 1 fish from 1 September to the end of the season. The Bye-law also provides for the use of single hooks and prohibits the use of worms as bait once the specified number of fish have been caught in the specified periods.

      SHANNON FISHERIES REGION (Prohibition on Angling) BYE-LAW No. C.S. 289, 2007  This links to a Microsoft Word Document

      This Bye-Law prohibits angling for all species of fish during the period 1 March to 30 September in that section of the Lower Shannon as specified in the Bye-law i.e. Lower River Shannon from Plassy Bridge adjoining the townlands of Sreelane in the county of Clare and Garraun in the county of Limerick to Thomand Bridge in the city of Limerick during the period commencing 1 March and ending on 30 September in any year.

      S.I. No. 672 of 2006 - WILD SALMON AND SEA TROUT  TAGGING  SCHEME (No. 2)   REGULATIONS 2006  This links to a Microsoft Word Document

      These regulations provide, for among other things, for the quotas of fish that can be harvested by commercial fishing engines and rod and line from those rivers identified in schedule 8 as having a surplus above the conservation limit. In the case of the Shannon (Limerick)  Fisheries Region, quotas apply to the River Feale (4,688) and Mulcair (1,349)

      CONSERVATION OF SALMON AND SEA TROUT BYE-LAW NO.  815, 2006  This links to a Microsoft Word Document

      This Bye-law provides for catch and release in respect of salmon and sea trout (over 40 cm) in the rivers mentioned in the Bye-law (none listed in Shannon (Limerick) Fisheries District  - see Bye Law No 287 below). This Bye Law comes into operation on January 1st, 2007.

      CONSERVATION OF SALMON AND SEA TROUT BYE-LAW NO. C.S. 287, 2006  This links to a Microsoft Word Document

      This Bye-Law prohibits angling for salmon and sea trout (over 40 cm) in the rivers specified in the Bye-law. In the case of the Shannon (Limerick)  Fisheries District this applies to Rivers Brick, Galey, Deel, Owenagarney (Ratty), Skivileen, Aughyvackeen. Doonbeg.

      CONSERVATION OF SALMON AND SEA TROUT BYE-LAW NO. C.S. 290, 2007  This links to a Microsoft Word Document

      This Bye-law prohibits the taking or attempting to take by rod and line salmon and sea trout over 40 cm.  The Bye-law also provides for the closure of the river Black Water in Waterford and incorporates the provisions of the existing close rivers Bye-law No. C.S. 287, 2006 above

      S.I. No. 670 of 2006 - SALMON ROD ORDINARY ROD LICENCES (Alteration of Licence Duties) ORDER 2006  This links to a Microsoft Word Document<

      This Order prescribes the licence fees payable from 1 January 2007 in respect of salmon rod ordinary fishing licences and the Foyle Area extension licence including a salmon conservation levy equivalent to 50% of the licence fee.  The proceeds of this levy will be invested in wild salmon management initiatives designed to rehabilitate wild salmon stocks and habitats.
