Can you guys help me if the collector has put a lean on my house already and wants a payoff now???

Chris Lehr, is the company collecting from you for an unsecured debt or a secured? If the debt is unsecured, the contract must mention clearly about the lean procedure.

You have to make payment arrangements with the company and avoid the lean on your house if they have the legal rights. Sometimes, it is easier to deal with the original creditor. Talk to them and see if they can offer you with something that suits you.

If there's a lien on your house already, it can only be because of a mortgage/deed of trust (in which case the lien was there when you signed the papers originally) or because the creditor has already gotten a judgment against you. Check at your local courthouse and see if anyone's sued you. If they did, and you didn't get notice of it, file a motion to set aside the judgment.

Chris, get an attorney to help you on this. Liens can be tricky.. as the other posters have said the lien may or not be valid depending on a variety of things. These things include proper filing, proper notification, legal mechanism under which the lien was/will be field. What kind of a debt is it? has the lien actually been filed? were you given notice of its filing?

hello I am a small time painting contractor,and always
get signed contracts before doing the jobs,but recently someone I have known for about 15 years,put
his house up for sale and moved 8 hours away,he asked
me to paint his house he we had a verbal agreement
on price and he was in a hurry to move..I have since
painting the house and hes beating around on paying
us coming up with all kinds of excuses..can I put a lien on his house???

Anyone puts a lien on your home does that mean you lose your home.

It doesn't mean you lose the home. It means that should you refinance it or sell it then they would automaticaly gt their money first before you did.

All a lien means is if you go to sell or refinance you have to pay that debt off. My homeowners association put one on my property earlier this year, now its gone because I paid the debt off. No BIG deal

my brother passed away and he had a judment put against him for failure to pay on a ring he purchased, however their is a lien on my home i'm assuming because they think its me. Our names are the same except Jr, & Sr. He never used Jr.

i live in NJ and work with foreclosures. i have seen houses go to sheriff sale over home association fees and liens. i do not know if they actually lose their house but am pretty sure i remember evictions in this and the third party having to take over the mortgage.
someone please correct me if i am wrong but i really have seen this happen.
