A collection agency is demanding money on a debt that took place about 10 years ago. I need to know if I need to pay this debt. This debt was a promissory note to a school. No bank was involved in between and I was supposed to pay directly to the school. I have not attended that school and I find today that the school is also not functional. What should I do?

Welcome to the forums.

Not paying this promissory note does not mean that you do not owe this debt. But since this debt took place 10 years ago, you now need to know if this account is within the SOL period or not.

Depending upon the state laws, you need to check the SOL in your state in regards to the date of last activity in this account. You can send a cease and desist letter to stop the collection agency from calling you at your place. The CA should not place a call to you after receiving your cease and desist letter unless to notify that some legal actions will be taken against you.

If they intend to take any sort of legal actions, you need to dispute the debt in writing to the court based on the statutes of limitation. You can take some consultation from a private attorney for further advice on how to tackle this matter.

this agency have no contract with you ... just ask them to produce a copy of the contract between you and them .. that gave rise to this debt.. and what value did they provide..... they will be gone quick...

Did you enroll in a school and then not pay? Maybe a school by a different name? (Schools buy up other schools.)Did you enroll and then not attend?

Educational debts have no SOL so they never run out. If you enrolled and decided not to attend and didnt withdraw, legally you can be held responsible for the entire tuition.
