General Office

The General Office assists the SAIC top management in its daily work. It is responsible for drafting important documents, creating office files, arranging press releases, managing information, organizing meetings, undertaking and coordinating surveys, drafting and implementing education/communication programs, and performing financial and statistical duties.

 

Department of Law

The Department outlines the legislative framework of administration for industry and commerce. It is responsible for drafting, coordinating and promulgating relevant rules and regulations. The Department also undertakes or takes part in administrative review, response to litigations and settlement of indemnity issues.  Furthermore, it organizes legal education and training programs.

 

Fair Trade Bureau

The Bureau takes charge of the formulation and enforcement of rules, regulations and practice directions for preventing monopoly and unfair competition. It also initiates investigations to penalize economic offenses such as monopoly, unfair competition, smuggling, and selling of smuggled goods.

 

Direct Selling Regulation Bureau 

The Bureau drafts and enforces regulations and measures on regulating direct selling and prohibiting pyramid selling. It regulates direct selling behavior and maintains the market order thereof in accordance with Regulation on Direct Selling and Regulation on Prohibiting Pyramid Selling of the State Council. It assists commerce authority of the State Council in examining and approving the establishment of direct selling corporations. The Bureau also supervises direct selling corporations, sellers and their activities; settles cases of offences; guides local AICs in their efforts to regulate direct selling and prohibit pyramid selling.

 

 

Consumer Protection Bureau

The Bureau drafts and enforces regulations on consumer protection and the implementation rules thereof.  It launches investigation to penalize serious infringements on consumers’ legitimate rights and interests, oversees the quality of marketed goods, investigates and penalizes the selling of fake and/or substandard goods and other irregularities.

 

Department of Market Regulation

The Department drafts and enforces regulations on supervising market order and the implementation rules thereof. It regulates market order and contract performance in accordance with law and initiates investigation to penalize contract frauds and other illegal acts. The Department also administers the registration of chattel mortgages, regulates auctions and launches special campaigns for control of acute problems in marketplaces.

 

Enterprise Registration Bureau

The Bureau drafts and enforces regulations on enterprise registration and the implementation rules thereof.  In the process of enterprise registration, the Bureau examines and approves business names, issues business licenses to enterprises and other operating units within its jurisdiction, and regulates registration behavior. The Bureau also guides local AIC authorities in their efforts to facilitate and regulate registration of enterprises. 

 

Registration Bureau of Foreign-invested Enterprise

The Bureau drafts and enforces regulations on registration of foreign-invested enterprises and the implementation rules thereof.  When foreign-invested enterprises and resident representative offices of foreign companies apply for registration, the Bureau examines and approves business names, issues business licenses to such applicants within its jurisdiction, and regulates registration behavior. The Bureau also guides local AIC authorities in their efforts to facilitate and regulate registration of foreign-invested enterprises. 

 

Department of Advertising Regulation

The Department drafts and enforces regulations on the advertising industry and the implementation rules thereof. It regulates advertising activities, investigates into and punishes illegal practices such as fraudulent advertising, and provides guidance to advertising review agencies and advertising associations.

 

Department for Regulation of Private Economy

The Department researches on the development and administration of the private economy and develops regulations on the administration of private economy and the implementation rules and practice directions thereof.  It also provides guidance to the registration and regulation of private businesses as well as associations of self-employed and those of private enterprises.

 

Department of Personnel and Education

The Department administers the personnel and organizational setup of SAIC and units affiliated to SAIC. It assists the top management of SAIC to jointly supervise leading teams of provincial AICs in cooperation with local governments. In addition, the Department formulates and implements education and training programs and provides guidance to the development of local AICs.

 

Department of Foreign Affairs

The Department carries out international cooperation and exchanges in the field of administration for industry and commerce, including but not limited to recruiting international talents, organizing overseas training programs and taking charge of other international liaison affairs of SAIC.

 

Trademark Office

The Trademark Office formulates or participates in the formulation of regulations on trademark registration and administration; takes charges of nationwide trademark registration; rules on opposition to trademark application; revokes registered trademark; investigates into cases of trademark infringements and fakes and metes out corresponding penalties. It also guides local AICs in trademark issues and assists the latter in administrative review of trademark infringement cases.  Furthermore, the Office is responsible for filing of trademark licensing agreements, regulating trademark printing, recognizing and protecting well-known trademarks and supervising trademark agencies. In addition to the collection of trademark information and filing thereof, the Office also implements international trademark treaties and agreements within the territory of the People’s Republic of China, and conducts international exchange and cooperation related to trademark.

 

Trademark Appeal Board

The Board reviews, at the request of the concerned party, trademark registration and assignment applications rejected by the Trademark Office. It also reviews, as requested by the concerned party, rulings on oppositions to trademark application and rulings on trademark revocation that are made by the Trademark Office. Apart from trying cases of trademark disputes and applications for revocation of improper trademark registrations submitted by concerned parties, it also participates in litigation proceedings concerning decisions on ownership of trademark right.
