Kenneth Halpern & Associates
Business Litigation

Kenneth Halpern & Associates regularly represents its business clients in a variety of matters, such as:

Intra-Company Ownership Disputes

Sometimes partners or owners can't get along and must go to Court to resolve their rights in the business property. On some occasions one owner in a small business will "lock-out" the other owner and the only recourse the locked-out owner has is to go to Court.

Collections and Breach of Contract

Whether you sell your products and services to a customer or client and they don't pay you under the terms of the contract, or if you pay someone for their products and they don't deliver, you have legal rights to either be paid, get a refund, recover property, or otherwise enforce your rights. Kenneth Halpern & Associates attorneys regularly appear in court fighting for our clients' rights.

Mechanic's Liens

If your business has provided goods or services to improve or repair real estate, you may be able to enforce a lien against the property. Likewise, some unscrupulous business owners will wrongfully file mechanic's liens and you need to defend yourself.

Many leases start out well, but end on bad terms. When a tenant stops paying rent or otherwise breaks the lease, it is difficult to remove them from the property. If you try to forcibly remove them, you may even subject yourself to a lawsuit. Our offices will handle the legal process for you efficiently.

Administrative Matters

Businesses often encounter tax issues with the state, insurance regulatory concerns, licensing issues, and other matters that are not always litigated in the Circuit Court. Some of these matters are resolved before administrative tribunals which have unique procedural requirements.

Stock Broker Negligence

If you were a victim a stock broker fraud, we can help! If the investments were not suitable for you, and if you were harmed, you may be entitled to be compensated. We handle the cases for:

  • Equity Indexed Annuities
  • NASD Arbitration

Sometimes you may not win at trial. It may be that you did not have adequate representation at trial, or it may just be that the Judge in your case made an error. Although Judges strive to do what is right, sometimes their decisions are inconsistent with the law.

If you find yourself in the position where either you believe your trial judge erred, or you won at trial and now must defend an appeal, call our offices and we will represent you before the Court of Appeals or the Florida Supreme Court.

Do not delay in contacting our offices as the clock is running and any delay may cost you your rights!
