Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation
Commission, at the Public Meeting of February 13, 2007, following the Public Hearing and Public Meeting of
December 5, 2006, the Landmarks Preservation Commission voted to grant a Certificate of Appropriateness for
the proposed work at the subject premises, as put forth in your application completed on November 24, 2006.
This permit will expire on February 13, 2013.

The work, as approved, consists of, at the roof top, removing the existing asphalt roof and constructing a new
metal and glass roof which maintains the form and massing of the front of the existing roof; squaring off the rear
of the roof and installing a metal and glass panel wall; removing the existing decorative copper flashing and finial
and reinstalling on the new roof; installing new copper flashing; installing a new skylight; installing new glass
railings at the front and rear of the roof; and installing a new cast stone cornice; and, at the ground floor of the
front façade, relocating the existing main entry door and surround to the westmost bay; installing a new retail
display window at the location of the former main entry; and, at the front and rear facades, cladding the base of
the building in limestone. This work was shown in photo boards; material samples; and drawings A101 through
A103, dated January 10, 2007; and PH108 and PH109, dated January 9, 2007; prepared by M Studio, and
submitted as components of the application, and presented at the Public Hearing and Public Meeting. The
proposal as originally presented called for a two-story penthouse addition as shown in photo boards; material
samples; and drawings A0, and A100 through A110, dated December 4, 2006; A111, dated November 28, 2006;
and A109, dated December 4, 2006.

In reviewing this application, the Commission noted that the Upper East Side Historic District designation report
describes 23 East 67th Street a rowhouse designed by Robert Robertson and built in 1882-1883 and redesigned in
the neo-Federal style by Sterner and Wolfe in 1919. The Commission also noted that a new façade was built at
the front property line and an additional story was added subsuming the original peak roof in the 1919 redesign
and that the building was converted to retail use ca. 1933. Finally, the Commission noted that Permit for Minor
Work 98-0109 (LPC 97-6128) was issued July 7, 1997, for "restorative facade work, including cleaning and
repointing the facade."

With regard to this proposal, the Commission found that the historic massing of the rooftop addition and historic
copper details will be maintained; that the raised roofline will be minimally visible for a short distance mid-block
on the east side of Madison Avenue when walking north between East 66th and East 67th Streets, and will not
detract from the roofscape of the block; that the proposed rooftop addition will be set back from the rear
maintaining the original volume of the building; that the proposed cornice will relate to cornices found on
adjacent buildings that have had their height increased by the addition of extra stories; that the relocation of the
main entry door and surround will not result in the loss of any historic fabric; that the replacement of the
secondary entrance door with a window will maintain the transparency and fenestration pattern of the historic
ground floor storefront; that the relocation of the main entry door and the new window opening and sash will not
detract from the significant architectural features of the building or the streetscape; and that the proposed
limestone cladding of the ground floor will relate to other ground floors on the block and will help to unify the
various elements of the façade. Based on these findings, the Commission determined that the work is appropriate
to the building and to the historic district, and voted to approve this application.

However, in voting to grant this approval, the Commission made its determination subject to the stipulation that
two sets of final signed and sealed drawings, showing the approved work, which are to be filed at the Department
of Buildings, be submitted to the staff of the Commission for review and approval.

Subsequently, on March 8, 2006, the staff of the Commission received drawings A000, A001 through A005, A6
through A9, A010, A11 through A16, A017, A018, and S100 through S102, dated March 5, 2007; M101 through
M108, SP101, and SP102, dated received March 8, 2007; E001, E101 through E108, and P101 through P108,
dated February 5, 2007; prepared by Anthony J. Morali, R.A. The Commission reviewed the submitted drawings
and found that proposal approved by the Commission has been maintained. Therefore, these drawings are being
marked approved by the Commission with a perforated seal, and this Certificate of Appropriateness is being
issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed
during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual
building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves
the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building
or site conditions are materially different from those described in the application or disclosed during the review
process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of
approval. The work is limited to what is contained in the perforated documents. Other work or amendments to
this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or
maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or
civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently
