Privacy Policy and Other Agreements
A Privacy Policy Unlike Any You've Ever Ignored Before
YouthNoise is a web-based program created to motivate young people ages 13-26, to improve their lives and the lives of children and youth, worldwide, through volunteering, fundraising and speaking out. (Whew. Say that ten times fast.) YouthNoise Inc. is a non-stock corporation and is a tax-exempt organization pursuant (that's right, we said 'pursuant') to Internal Revenue Code Section 501(c)(3). In other words, we're not in it to make money. If you sign up/register with YouthNoise on our web site to become a NOISEmaker, you'll have the chance explore issues affecting young people, connect with your peers about these issues and take action to make change. You'll get to use our interactive tools, created to inform people about opportunities to get involved in volunteer activities, either online, or in their area. And you'll also have access to all sorts of news and information through linked sites. Please read this Privacy Policy and Other Agreements carefully, as it describes our understanding with you regarding your participation in YouthNoise. We reserve the right to change, modify, add or remove portions of these terms whenever we want. If you continue to use the site after changes to the terms, it means you have accepted those terms. And believe us, while it is our mission in life to make your experience a meaningful and safe one, we would like to point out that you are interacting on the YouthNoise site at your own risk. A. PRIVACY POLICY YouthNoise believes that privacy is important. The YouthNoise site does collect personal information about you, so please read carefully so you understand what personal information YouthNoise might collect and how it might be used.

1. What kind of personal information does YouthNoise collect?
Personally/Individually Identifying Information: The personally identifying information that will be collected by YouthNoise at certain areas of the site (including but not limited to registration, profiles, myNOISE, contests, and submission permission slips) will include: a. your name b. city/town/region, state, and country c. home or other address and zip code d. birthday (month, day, year) e. telephone number f. e-mail address g. IM screen name and provider Our policy regarding this information is simple: except as provided in this Privacy Policy and Other Agreements, we will not disclose, sell or rent any of the personally/individually identifying registration information you provide without telling you in advance and giving you the opportunity to tell us not to share the information. We make an effort to include a link to this Privacy Policy and Other Agreements wherever we ask you for personal information. Why does YouthNoise want to know how old I am? The YouthNoise registration process is designed to ensure that no one under the age of 13 joins YouthNoise. If YouthNoise receives notice or otherwise learns that a NOISEmaker has provided incorrect information during registration and is actually under 13 years old, YouthNoise will close the account. Further, if law, or some other authority compels us, YouthNoise will disclose registration information (including personally/individually identifying information). Also, if we have reason to believe that there has been some inappropriate interference or use of the YouthNoise site (including copyright or trademark infringement), or if we have reason to believe that a NOISEmaker may have been injured or some other party harmed, we will disclose personally/individually identifying information as we deem appropriate or if asked by an authority. Other Personal Information: We also collect other information at certain areas of the site (including but not limited to registration, profiles, myNOISE, contests, and submission permission slips) that tells us about who you are and what you like to do: such as your hobbies and interests. This information will not be used by YouthNoise to identify you individually without your permission. We do, however, place this information in your NOISEmaker profile, which is available to other NOISEmakers so that NOISEmakers who share your interests can connect with you. In addition, if you agree to do so, you might be highlighted on the site as a featured NOISEmaker, which would encourage other NOISEmakers to review your profile and contact you. We may use some of this other personal information (but nothing that identifies you individually) to give our site sponsors, advertisers and linked Web sites the general picture of our NOISEmakers (for example, do more NOISEmakers like to watch TV or listen to CDs?). This will help keep the YouthNoise site interesting for you, help target (and thus make more useful) the sponsors with whom we work, and help us develop the appropriate services offered through the YouthNoise site. Remember, YouthNoise will not share your individually identifying information with site sponsors, advertisers, linked Web sites and/or any third party.

2. Are there other companies or people that will receive or collect information about me?
Some of our services, such as boards and homepages, are offered through other companies. These companies work with us to provide the YouthNoise site with up-to-date information and services. In order for these associates to provide you with information and services, YouthNoise must disclose certain information about you, including your YouthNoise username, city/town/region and state, and your date of birth. In order for you to access public profile data while in the boards, YouthNoise will also disclose highlights of your NOISEmaker profile including your gender, homepage URL, the date you registered as a NOISEmaker, and select interests. These associate companies may also ask you for some additional personal information. While we believe these other companies are upstanding members of the Internet community and will treat your personal information responsibly, we don't own or control them and can't speak for them on privacy issues. Don't forget, anytime you leave the YouthNoise site, we cannot control what information may be collected about you nor can we control what others might do with it. You should be aware that our site sponsors, advertisers or linked Web sites may collect personal information about you. This privacy statement does not address the information practices of those site sponsors, advertisers or linked Web sites. Remember, you have a choice about whether or not you want to provide personal information and you should always exercise this choice responsibly and with care.

3. Does the YouthNoise site use cookies?
Yes, we do. As you know, a cookie is a small piece of data that is sent to your browser from YouthNoise's Web server and is stored on your computer's hard drive. YouthNoise uses cookies to keep and sometimes track information about you in order to deliver better and more personalized services. Cookies will allow us to access your NOISEmaker information, which is stored on our computers; to track entries in our polls; to track entries in other promotions; and, to identify which areas of our site you have visited. We may also match information obtained from cookies with data you provided or provided by third parties. This information is generally used either as a group statistic or may be an individual statistic. For example, we might use the information to determine if there are more male NOISEmakers or female NOISEmakers participating in YouthNoise. Again, this information helps YouthNoise provide services and site content that is interesting to you. As discussed earlier, our site sponsors, advertisers or linked Web sites may use cookies, too. YouthNoise does not own or control these entities and this statement of policy does not cover how these companies use their cookies.

4. What kind of protection is there for my personal information?
Your NOISEmaker Profile is password-protected. This means that only you will have control over who can access your identifying information. To make the password protection helpful, do not give your password to anyone. If you are using a shared or public computer, we suggest that you closeout of the YouthNoise site and sign off from the computer when you are finished u this will help protect your information. (For example, don't leave the school or a library computer running and open at the YouthNoise site, closeout your turn before someone else starts using it.) When you create your NOISEname and password, please avoid using personally identifiable information such as your name. YouthNoise does endeavor to use secure technology where practical, however, no data collection technology or data transmission technology is 100% secure. Unfortunately, we cannot guarantee the security of information provided or sent to us. Remember, you are participating in YouthNoise at your own risk.

B. ACCEPTABLE USE POLICY AND AGREEMENTS
If you accept the Privacy Policy and these Other Agreements, you agree to the following terms and conditions for use of the YouthNoise site. These terms and conditions have been developed for your protection as well as ours.

1. Use of YouthNoise Materials.
The YouthNoise program and site is presented for your education, information and enjoyment. YouthNoise associates, other NOISEmakers or other third party service providers own the materials and technology included on the YouthNoise site. You agree not to use any of the material or technology for any purpose, including personal financial gain or other inappropriate activity. You agree to maintain the integrity of the information and materials presented at the YouthNoise site, and you will not edit or otherwise alter the content or form of the materials and information so presented. YouthNoise endeavors to respect the intellectual property of others, and their rights in and to protected property. YouthNoise asks that you act with the same respect. It is improper, and may be a violation of law, for you to post or distribute any material that you do not own or for which you do not have permission to use. PLEASE BE AWARE: violation of someone's copyright, trademark, or other intellectual property rights may subject you to civil or criminal penalties.

2. Illegal and Inappropriate Use of YouthNoise Materials and/or Technology.
Use of the YouthNoise materials or technology is strictly limited to informational, educational and fundraising purposes. Use of the YouthNoise materials or technology for illegal, inappropriate, or obscene purposes, or in support of such activities is strictly prohibited.
"Illegal activities" are those that violate laws, regulations and/or private agreements, including federal or state laws governing charitable activities, copyright laws, trademark laws, license agreements or other intellectual property rights.
"Inappropriate uses" are any uses other than for legitimate informational, educational or fundraising purposes.
"Obscene activities" are those that violate generally accepted social standards for use of this type of material or technology.
o Illegal or Inappropriate Use of the YouthNoise materials or technology shall include, but is not limited to:
* Intentional misuse;
* Degrading the YouthNoise material or technology;
* Using the YouthNoise material or technology for personal commercial or financial gain and/or fraud;
* Gaining or seeking to gain unauthorized access to resources or entities;
* Invading the privacy of other individuals or entities;
* Possessing any data which might be considered a violation of these rules in paper, magnetic (disk), or any other form or medium;
* Releasing the full name, personal address or telephone number of any NOISEmaker to third parties or posting this information anywhere on the site.
o You are entirely responsible for all of your activities on YouthNoise. PLEASE BE AWARE: YouthNoise will terminate your participation at the YouthNoise site in the event we, in our sole discretion, determine that you have engaged in a prohibited activity. Listed below are some, but not all, prohibited activities that may result in termination of your ability to participate as a NOISEmaker: * Post, transmit, promote, or distribute content that is illegal. * Solicit sexually explicit photographs or text from other NOISEmakers. * Harass, threaten, embarrass, or do anything else to another NOISEmaker that is unwanted. This means: you should not say untrue, unkind or inappropriate things about another NOISEmaker to others, you shouldn't send unwanted messages (or keep sending messages after being asked not to) and you should never attack a person's race, heritage, religion, gender, sexual orientation, etc. * Post anywhere on the site, or in any way create, transmit, transmit links to, or facilitate distribution of content that is untrue, threatening, harassing, abusive, racially or ethnically offensive, hate propaganda, vulgar, sexually explicit, obscene, defamatory, or objectionable. If you aren't sure about something that you want to say or do, before saying it or doing it, ask an adult, friend and/or relative. * Disrupt the flow of chat or bulletin board areas with vulgar language, abusiveness, repeatedly submitting the same content, explicitly sexual content or other conduct that may disrupt normal activities. * Pretend to be anyone whom you are not. You may not impersonate another NOISEmaker, YouthNoise staff, or anyone else. * Attempt to get or steal a password, other account information, or other private information from another NOISEmaker, or harvest e-mail addresses or other information. * Post any unsolicited advertising, promotional materials, or any other forms of solicitation including but not limited to mail fraud and pyramid schemes. * You cannot obtain paid advertising for your YouthNoise homepage or advertise your company or products on YouthNoise. * You will not send unsolicited email, spam to newsgroups, or spam to Internet search engines, which reference your YouthNoise homepage. * You cannot copy any other page and/or images for your YouthNoise homepage, without prior consent from the originator of the other page and/or images. * YouthNoise reserves the right to delete any page or other content it deems unacceptable for any reason without prior notice. * Homepages created by NOISEmakers are subject to removal, if there is no activity (hits or edits) on the page for 60 days. C. NOISEMAKER SUBMISSIONS, SITE CONTENT AND HYPERLINKS

3. NOISEmaker Submissions.
WITH THE EXCEPTION OF PRIVATE E-MAIL, ANY TIME YOU UPLOAD TO, DISTRIBUTE THROUGH, OR PUBLISH ANY MATERIALS THROUGH THE YOUTHNOISE SITE, YOU HAVE GRANTED YOUTHNOISE THE RIGHT TO EDIT, COPY, REMOVE, DISTRIBUTE, CREATE NEW WORKS USING THE MATERIALS, AND/OR PUBLISH THE MATERIALS IN ANY FORM AND MEDIUM, WHETHER ELECTRONICALLY OR IN HARD COPY AND WHETHER ALONE OR AS PART OF A COLLECTIVE WORK. YOU SHALL RETAIN, HOWEVER, WHATEVER OTHER RIGHTS YOU HAVE IN PRE-OWNED ELEMENTS OF SUCH MATERIALS.

4. Written Permission.
Before we will post any NOISEmaker materials for publication (e.g. a poem, picture, story, or other property) YouthNoise requires you to provide us with a permission slip and statement of ownership. The form must be signed by you, and if you are under the age of 18, by your parent or guardian. Until this permission has been submitted, YouthNoise cannot publish your materials. 5. Site Content.
Postings, hosted/moderated chats, open chats, and any other communication by NOISEmakers are not necessarily reviewed, screened or approved by YouthNoise nor does the content of posted materials, messages, or other communications necessarily reflect the views of YouthNoise. We reserve the right, without further notice, to remove any content or communication received from a NOISEmaker, or other user, including without limitation, postings made to bulletin boards and/or chat communications.

6. Hyperlinks.
The YouthNoise site contains hyperlinks to Web sites operated by others. These hyperlinks are provided for your convenience (and discretionary use) and we do not control and are not responsible for the content or services at other Web sites. The phrase ogo too before an external website address indicates that the link which follows is to a Web site operated by others.

7. YOUR USE OF THE YOUTHNOISE SITE IS AT YOUR OWN RISK. THE YOUTH NOISE PROGRAM ASSUME NO RESPONSIBILITY AND/OR LIABILITY FOR: * THE CONTENT OF ANY MATERIAL OR COMMUNICATION CREATED BY YOU, ANY THIRD PARTY OR RECEIVED BY YOU FROM A SOURCE OUTSIDE THE YOUTH NOISE SITE; * ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES, LIABILITY AND/OR COSTS, INCLUDING ATTORNEYS FEES, CAUSED BY THE WAY YOU USE THE YOUTH NOISE MATERIALS OR TECHNOLOGY, INCLUDING BUT NOT LIMITED TO CLAIMS OF SLANDER, LIBEL, INFRINGEMENT, AND/OR PLAGIARISM; * ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES, LIABILITY AND/OR COSTS, INCLUDING ATTORNEYS FEES, ARISING FROM YOUTH NOISE SERVICE INTERRUPTIONS, INTERNET SERVICE INTERRUPTIONS OR CHANGES, EVEN IF THESE DISRUPTIONS ARISE FROM CIRCUMSTANCES UNDER THE CONTROL OF YOUTHNOISE; * ANY OTHER DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE DAMAGES OF ANY KIND, INCLUDING ATTORNEYS FEES, ARISING FROM YOUR PARTICIPATION AS A NOISEMAKER; * PRIVACY IN CONNECTION WITH YOUR USE OF THE YOUTH NOISE SITE AND/OR OTHER INTERNET ACTIVITIES (EXCEPT IN THE CASE OF ANY WILLFUL OR GROSSLY NEGLIGENT BREACH OF THE PRIVACY POLICY BY THE YOUTHNOISE PROGRAM).

8. EVERYTHING ON THE YOUTHNOISE SITE IS PROVIDED TO YOU "AS IS," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHATABILITY OR FITNESS FOR A PARTICULAR PURPOSE, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION.

9. If you do something that, according to the terms of the Privacy Policy and Other Agreements, warrants your termination from the service or expulsion from the YouthNoise site, you accept full responsibility for anything that happens afterwards, including indemnifying and holding YouthNoise harmless from any and all claims by others arising from your conduct and/or use of the YouthNoise site, and/or the materials and services provided.
