Boston Pizza settles dispute with Boston Market over the name Boston

Boston Pizza Royalties Income Fund (TSX:BPF.UN) has settled a trademark dispute with Boston Market over the use of the name Boston, the fund said Friday.

Under the deal, Boston Market said it will not use in Canada the words "Boston" or "Boston Market" for five years for restaurants or any food or drink products other than pre-packaged food products, but not including pizza and lasagna.

Boston Market also agreed it will not challenge the use in Canada by Boston Pizza of any trademark that uses the words "Boston" or "Boston Pizza" except for certain trademarks of Boston Market for five years.

Boston Pizza International and the fund have agreed not to challenge the use by Boston Market of the trademark "Boston Market" for pre-packaged food products, except pizza and lasagna. Boston Market restaurants stopped operating in Canada in 2004.
