City will let 'Occupy' protesters stay for free

Three Council members vote against fee waiver

Those participating in Occupy Buffalo won't have to dole out any cash to continue their encampment in Niagara Square.

The Common Council on Tuesday waived a $500 permit fee for the demonstrators.

City lawmakers — who were split on the issue, with three voting against the waiver — spent about 30 minutes debating the issue in Council Chambers.

Majority Leader Richard A. Fontana, University Council Member Bonnie E. Russell and North Council Member Joseph Golombek Jr. opposed granting the waiver.

"They're sleeping out there every night, and that's against the city ordinances," Fontana said.

Any homeless person caught sleeping in a city park at night would be arrested, the Lovejoy Council member said, noting the pickets should respect the laws of the city.

The lawmaker said the occupiers should respect city taxpayers by not using power or ruining the grass in Niagara Square.

Golombek said his vote against the waiver had nothing to do with the message of the Occupy Buffalo movement. He said the city's going to have to fix up Niagara Square after the demonstrators leave, and taxpayers are going to end up footing the bill.

Russell and Golombek questioned what standard there would be if others request a permit fee waiver.

The measure to waive the fees was sponsored by Council President David A. Franczyk, Niagara Council Member David A. Rivera and Delaware Council Member Michael J. LoCurto.

LoCurto credited Mayor Byron W. Brown and Buffalo police for dealing with the group and not seeing the demonstration escalate into violence.

"The mayor and the administration deserve a lot of credit for letting these people exercise their constitutional rights of freedom of assembly and forming a good relationship with the occupiers," LoCurto said.

Look, a lot of these people have jobs already. And I know a person that has been looking for a job for the better part of 2 years. Despite previously earning over 55K per year with 23 years experience.

No one wants to hire her. They either fear that she will bolt when a better job comes along, or that she will eventually want a raise to go with her experience. The market sets wages, not employers. Filling out application after application and getting turned down for being "overqualified" which really means that we can find someone who is more desperate to take this job than you are.

She applied at one job for a national company and was asked time and time again at her second interview. "why are you applying for a job that pays so much lower than what you made before?" They told her to her face at the interview that they felt that the pay was too low and that they were certain that she would leave if another job opened up.

Hiring costs companies money. There are background checks to be paid for. There is the time that it takes to read every application, and there is the time devoted to interviews. All in all it costs money to hire a person, and you don't want to hire for the same position every other month. Better to hire the best most desperate candidate that you can who will hold onto that job like gold and needs it.

Being overqualified is worse than being under qualified. People that are under qualified do not have years of experience that can show up a manager and know better ways to do things. No one wants to hire someone that will become a threat to their own job.

This is no different than those stupid hippies back in 1776. The King of England gave them everything they wanted, and they complained because they had to pay a few taxes? What a bunch of left-ist losers, let them freeze in their stupid little shanty camps, I say!

I can't believe that, just because I'm rich and privileged enough to have private education and a cushy job through nepotism, I have to chip in with thousands of others to front the bill of a $500 permit and an additional $50 for grass seed. Wait, never mind, I live in the suburbs. I can't believe thousands of OTHERS will have to pay the bill. We would never have to pay for grass seed, especially not in the springtime, if these punks weren't wasting their time protesting instead of finding jobs that don't exist. If they want their voices heard, why don't they ask for donations and run for office where real changes are made?

This is ridiculous, what a complete waste of time and money. Just give up and get a job that pays you to comment on Buffalo News articles like I did. Now, if you excuse me, I 'm taking a half day so I can go to the casino.

I have to agree with Mary Fornes. These people are NEVER going to find jobs if they are sleeping downtown in tents, all smelly and disgusting. And PHILIP JAMES JAROSZ, the governement is not there to "take care" of the citizens. Why are these people not "occupying" Washington DC if that's the general thinking? What happened to self-reliance and pride? In this country, the citizens have the right to PURSUE happiness, it's not a guarantee! If you don't work hard, you shouldn't have anything. We have become a nanny nation and it's time for that to end. The cry babies need to go back to their parents basements and back to their nonsensical blogging. It'll be warmer there for them.

So what's keeping you from heading down there and offering them these jobs?? I don't know of any good jobs but if you do and could help ANYONE get a job that keeps them off the dole then good for you.

@Jeremy: here's some good thinking...

Maybe some good-natured, civic-minded recruiters could go to the Occupy folks and try to get some of these "occupiers" into decent jobs that they could benefit from.

The "Occupy" folks want jobs? Match them with skills found in the jobs being offered, and let's see some good come from it.

They could have easily raised the $500.00. The city is just counting on the snow to end the protest peacefully. But I think that there may be some surprised people when the snow comes and they stay. This is a pretty driven movement. And I don't see why you would even need a permit for private citizens to be on public land. There's no curfew or anything like that like there are in the parks.

For every one person that is in this movement and camping out, there are many more behind them giving support.

Too bad the TEA Party didn't think about doing this first. Then again THINK and TEA Party don't really go hand in hand.

Let me guess, the square will be cleaned up by the protesters! I think NOT! The people who go to work every day and pay their own way will clean up the mess. How much more liberal can City Hall get? Is the Mayor afraid to do the job he was sworn to do? Get a set and enforce the law!

While no doubt well-intentioned, the above quote by Councilman LoCurto needs to be addressed. I would like to point out to him that it is not up to any elected officials or government bodies to "let" us exercise our rights. As citizens of this country we have these rights, PERIOD!
Kudos to the patriotic Occupiers found all over the world. Thank you for putting your convictions on the line in the face of apathy and misguided animosity from some of your fellow citizens. The majority of us support your struggle.
