Don't let Congress legislate torture or keep Guantanamo open

The Senate is poised to pass legislation containing provisions that would keep Guantanamo open, further entrenching indefinite detention and unfair trials. The Senate could vote at any time. To make matters worse, Senator Kelly Ayotte (R-NH) may introduce a provision that would enshrine “enhanced interrogation techniques”--that’s right, torture—in US law. The implications are staggering. We can’t let any of these provisions pass. I am writing to urge you--in the strongest possible terms--to oppose any provisions in the National Defense Authorization Act of 2012 (S. 1253) or in any other legislation that would keep Guantanamo open, block federal trials for Guantanamo detainees, restrict transfer of detainees, continue indefinite detention, or mandate military detention for terrorism suspects.

I call on you both to take a leadership role, as you have done in the past, to protect human rights by stripping the above provisions from any bills in which they are included.

I am also deeply disturbed by the possibility that Senator Kelly Ayotte (R-NH) may introduce a new provision that would enshrine â€œenhanced interrogation techniquesâ€â€” tortureâ€”in U.S. law.

I am shocked that Members of Congress would consider making human rights violationsâ€”whether indefinite detention, unfair trials or torture â€“ a part of U.S. law. These practices are crimes under international law. Congress should instead be working to end them and ensure that all those responsible for such abuses are held accountable.

I am counting on you to take a stand for human rights and the rule of law. Please oppose any provisions that would keep Guantanamo open, continue indefinite detention and unfair trials, mandate military detention of terrorism suspects or enshrine torture in U.S. law.

I believe that my security comes first and foremost from respect for human rights, not from torture and other abuses.
