    Prop. 8 gay marriage ban: Californians took away right of minority group, court rules

    A federal appeals court Tuesday overturned Proposition 8 on narrow grounds, ruling that Californians took away a right from a minority group without justification when they approved the 2008 ban on same-sex marriage.

    The 2-1 decision by the U.S. 9th Circuit Court of Appeals will have limited effect outside California because it is based on voter repeal of a right a minority already enjoyed.

    A woman who handed off her baby to a homeless person in a tent in downtown Los Angeles has been arrested, police said.

    Gay marriage: Court ruling on Prop. 8 has far-reaching implications

    More than three years after California voters approved a ban on same-sex marriage, an appeals court on Tuesday is set to decide whether Proposition 8 violates the federal Constitution.

    During oral arguments more than a year ago, the three-judge panel of the U.S. 9th Circuit Court of Appeals appeared to be leaning toward ruling against Proposition 8 but expressed concern about procedural matters.
