The Surprising History Of McCarran-Ferguson
WASHINGTON--The McCarran-Ferguson Act, the legislation which gave the insurance industry its limited antitrust immunity, has been perhaps the most hotly debated insurance issue in America since its enactment in 1945.
The news columns of National Underwriter have chronicled in magnificent detail the ongoing charges and countercharges among the foes and defenders of McCarran-Ferguson.
But just who were McCarran and Ferguson? And why did they do what they did? What were the events surrounding the insurance industry which, during the middle of World War II, drew the personal attention of President Franklin D. Roosevelt?
McCarran is Patrick A. McCarran, a former Democratic senator from Nevada. Born on Aug. 8, 1876, Sen. McCarran was both a farmer and a rancher while studying law in his spare time. He decided to pursue a legal career, eventually serving on the Nevada Supreme Court. He then decided to run for the Senate, winning election in 1932.
Known in his day as a conservative Democrat, Sen. McCarran served in the Senate for more than 21 years, until his death in 1954. A popular figure in Nevada, the international airport in Las Vegas bears his name.
Ferguson is Homer Ferguson, a former Republican senator from Michigan. Born on Feb. 25, 1889, Sen. Ferguson became a lawyer and a judge. From 1939 through 1941, he conducted a major investigation of corruption in the Detroit …
