Bhiwandi college can no longer be an exam centre: high court

The Bombay high court on Tuesday refused to lift the ban imposed on BNN College, Bhiwandi, as an examination centre, following the alleged involvement of some of its lecturers in last year’s third year Bachelor of Commerce (TYBCom) paper leak.

“In view of the fact that the petitioner institution itself has initiated an inquiry against three of its professors [for allegedly leaking TYBCom papers] and a fine is imposed on the college for negligence, the order of barring the college is not in any way arbitrary or unfair,” a division bench of justice SJ Vazifdar and justice RY Ganoo said, while dismissing the college’s petition.

The University of Mumbai had barred the college as an examination centre till 2015 after an inquiry conducted by a university-appointed committee found three professors of the college guilty of negligence and recommended disciplinary action against them.

The college then moved court on the grounds that it had been functioning as an examination centre for decades.

The college also claimed that owing to the ban, students from remote areas of Thane district had to travel to far-off centres in Kalyan and Ulhasnagar.

The bench rejected the appeal, saying, “If it is proved that you are not able to conduct the examinations properly, then why are you concerned about the students?”
