What constitutes marital property? That's the question activists, lawyers and women are attempting to determine following news of a recent proposal to amend Indian marriage laws to give women, in the event of a divorce, an equal share of the husband's inherited or inheritable property as well. The proposal, currently being discussed in the Union Cabinet, is only applicable to women in India;men will have no claim over their wives' ancestral property, should the amendment go through.
At the moment in India, women are entitled to an equal share of property acquired by the husband during or before the marriage. This does not include ancestral property.
