Burford strongly believes that litigation finance should operate as any other form of specialty finance, and that the funding of litigation should be fundamentally no different from the financing of other corporate assets – from aircraft to office equipment.

As such, we take a highly deferential and respectful approach to dealing with solicitors and claimants. This approach colours our position on some of the major issues regarding the professional relationship between financier and its client. For example:

Case Strategy
We firmly believe that strategy for a case should be determined by a solicitor and his client. We do not become involve in case strategy, and instead seek to insure that the highest quality counsel is involved in our cases.

Control of Settlement and Discontinuance of Funding
Issues regarding settlement and discontinuance are carefully spelled out in our agreements, and if there is a dispute between the parties as to appropriate action, the matter is subject to a QC clause and will be quickly and objectively determined. To be clear, we would only discontinue funding if there is a breach of contract, if the perceived merits of a case changes, or if a case is no longer commercially viable. Again, any such discontinuance is subject to the objective review and determination of a QC.

Capital Adequacy
As a publicly listed entity, our finances and our capital adequacy are transparent. We have millions of pounds of available capital.

All of the above positions are consistent with the code of conduct that has been promulgated by the Association of Litigation Funders of England and Wales, of which Burford is a proud member.
