    • recently I was admitted to the VA hospital in Syracuse New York, I’m a 100 % disabled vietnam veteran and was having a mild stroke. the hospital staff would not run any tests and discharged me from the hospital when they knew i had a suspecte TI..i then was taken to Crause hospital in syracuse and had m cooradic artery 85% blocked and cleaned out and they determined i had a mild stroke….I could of had a real big stroke what are my potential claims.

    Hi my name is Alan Lumpkin I suffer from High Blood Pressure, Carotid Artery Disease, and Permanent Nerve Damage in my back. I take several different meds.

    I have suffered terrible abuse and neglect at the hands of Birmingham VA Hospital in the past and have kept my mouth shut because of fear of having meds taken away, but since that has happened I feel Free to Speak Now. This report only deals with the last incident, I will address the others as my health allows. I am suffering Nerve Damage and withdrawal pains from opiates at this time.
    My main concerns are. No notification of change in my medicine. Illegal and improper drug screen test. No retesting or help with withdrawal from 10 years morphine use given by VA clinic.

    This report deals with the abuses done to me since my regular Doctor visit in April 2014
    I called to find out about my morphine and codeine prescriptions. I talked to Nurse Jennifer; she lied to me and misled me. I ask about my prescriptions. She informed me” I failed drug test, and the pharmacy canceled my refills. This is the first anyone has told me. She instructed me to call the pharmacy that Anniston/Oxford Clinic did not cancel or have anything to do with my prescriptions” ( I must have been miss lead to believing they were my care givers not the Pharmacy). After calling the pharmacy I was told they had nothing to do with that and I needed to call my care provider. They both told me the other was the one to speak to. This happens a lot. After calling back the nurse, she argued with me still insisting the pharmacy until finally she told me my doctor submitted cancelation on my Prescriptions. Ask did I want appointment: I said yes and was hung up on. Call back and Nurse was rude but finally gave appoint. Never ask could she help, never offer assistance withdrawals. To this Day May 13 or the 12 not sure, the withdrawals are on me hard and fast.

    I was not informed that I had failed Drug Test. The day of my doctor’s appointment in April. No one at this facility or Bhamingham told me anything about a test. I deny using cannabis at any time in the 10 years I have been on Morphine and Codeine. I have never failed before in 10 years. I have issues with the chain of custody on the test. I have taken mine home in the past with permission from the lab tech., was told just have it back by 2pm. The samples are not sealed and access is to anyone who wants it. The Veterans Administration is using the drug test to remove patients from pain medication. Mute point at this current time since I am in the midst of Morphine and Codeine withdraws.

    At this point I am left to withdraw off Morphine and Codeine on my own after 10 years of use prescribed by my VA Doctor. As painful and challenging as it is to try and put the events in order I may leave something out. I am already started suffering withdrawals and pray I do not have a seizure. I have had advance notice of the withdrawal Pain and suffering. I have this because VA has screwed up my prescription several times. At one time this Anniston/ Oxford Clinic could not send my order to Birmingham correctly. I had to come to their office and pickup the prescription for many months and hand deliver to pharmacy in Birmingham. That is just a sample of the treatment given at this Facility.
    I have a back injury Nerve Damage that will be rearing its ugly head as soon as the medication is out of my system. I will be in constant pain again that I would not wish on any human life. I will be unable to sleep because of the nagging pain that never stops.

    My Doctor failed in his duty to do me no harm. He also did me no good. I was not informed of discontinued use of narcotics. I was not offered a new test; I was not prescribed anything to help with the withdrawal process that I am currently involved with. I do not know if you or my doctor knows what withdrawal from morphine after 10 years is like. Let’s just say it might not kill a healthy person but it will make them wish they were dead. I am not a healthy person due to a back injury and Carotid Artery Disease. I am also holding VA responsible for any ill that befalls me due to the withdrawal from morphine after 10 years of use and the pain I will endure from my nerve damage.

    I have been treated as a second class citizen by the VA. I was not offered anything, rehab, and no treatment of any kind. I also feel I should have been given the opportunity to challenge the findings from drug test and given another test at the time of my doctor visit. I was not even told.
    Since writing the above on Wed. 5/6/14.
    They made an appointment for me the next day. I arrived 30 min. early thinking I would be retested or be prescribed medication for the withdrawal process. The first person I saw was the lady that weights me, temp and blood pressure (my blood pressure was high). She proceeded to show me the test results and tell me that she failed to tell me at my last appoint. I do not believe this person is the soul person responsible for the troubles I am having with my care providers, she has been the only one that has been honest and caring.
    At that visit I was told the VA wants everyone off narcotics and will be treating pain with rubbing and massaging per the seminars care providers are being given. The VA has set pain management back to the 1500s.
    I waited for over 1 hour 15 min. to see Doctor with only 2 or 3 people in the whole place. As I sat and waited I saw the Person that comes to pick up lab work to take to Bham. At that point I was thinking no Drug Screen My heart shank to my stomach.
    I finally was call by my Doctor Guzman, by this point I only had 2 questions. 1. Was I going to be allowed to have a drug screen (pi in the cup)today. I ask my Doctor Guzman if I was and was told NO. Question#2 Are you going to give me anything for withdrawal after 10 years of morphine use. The answer was NO. At that point I had nothing else to do but walkout and inform You I know longer will see Doctor Guzman whom has caused me more pain and suffering than I deserve.
    Please help me get another Doctor, I no longer have any faith in Dr. Guzman to do the best for my health. At this time I would like to file official complaints against, Doctor Guzman, Nurse Jennifer of the Anniston/Oxford Clinic
    As a post script I give you step by step of my last regular Dr. visit in April.
    My Doctor asks how I was and I told him good. From that point on my Doctor and I did nothing but have conversation about his journey from leaving this facility to work at Fort Rucker and his journey back to Oxford Clinic. Dr. Guzman never listen to my heart, my lungs nothing, he did absolutely nothing. He did not check anything. I ask for something for dry skin and craps he wrote prescriptions.

    All previous statements are sworn to be true. There is documentation for all statements made. If I rambled it is the withdrawals.

    P.S. Sunday: I thought I might die last night. I thought I could withdraw from this morphine on my own. I know better know. I have tried to get help from every place I have thought of. The VA has either no access or no help. I will seek private help. Oh the part about withdrawal will not kill me, well that is debatable.
    Have had no luck getting anyone to say. We will Help you.

    That is what the head of VA said I have been fighting weeks now to get help.
    Faithful was never what I would have called the VA. Detrimental to Veterans Health and Slow would be more like it.
    Since my stand to hold VA accountable I have heard horrid stores from other Veterans. Veterans do not deserve the Treatment we are now suffering. Our country called and We went period. If this country is not willing to take care of the men and women it sends off, then stop sending us.

    Everything is about the same, no doctor, No Help. Birmingham VA Hospital has done nothing about my medication. I continue to suffer back pain along with withdrawals. When they wanted me to quit smoking they gave me medication for that process. I no longer will sign a narcotic agreement until I know there is a chain of custody

  7. I’m exactly where you are my brother,the Hampton VA has chosen to terminate my morphine,(I have CHF-can’t take N-said,nor Tylenol,since a nurse in Salem,VA overdosed me. Anything with gabba I can’t take,plus cymbalta almost killed me,literally,but the record states anxiety,not true…
    I was misdiagnosed 38+yr ago,by military,was retired,civilian Dr( my child hood Dr) told me having a baby triggered my body hormones ,thus put me on medicine for thyroid.When he retired,I went for a refill,Dr told me,I was just a fat pig,I should starve myself,wouldn’t need to depend on pills.3years ago,same Dr said somehow I’d been misdiagnosed,yeah!he screwed me,I was sent to psychiatry told I’m crazy.if an MRI says herniated disc,but Dr says fibromyalgia,he’s wrong,but I’m the one in pain,and because I can’t take their drugs,they refuse ANY.I have an appointment with a new PC Monday,he has already decided what medicine I’m on to terminate AND he feels because I challenged the authority of the doctor I should be put out on fee basis,he believes my mental status is the real problem.I’m at the point,yes I also hesitated about bringing charges,but the staff all fall back that they’re protected from being terminated so they treat us worse than animals.
    I’LL BET IF WE WERE GITMO PRISONERS,WE’D BE TREATED WITH ABSOLUTE PRIVILEGE……BUT VETERANS ARE SUPPOSED TO BEG.
    I’m a female,have been raped by staff,who were supposed to protect,(as I was told that it was their word against mine-I’m just a crazy) SORRY…I KNOW THE TRUTH/I had post partum thyroiditis which untreated became hyperthyroidism,hyperparathyroidsm.All the years I was told I was nothing,now they label me disruptive..because I expect accountability in our physicians.
    I’m scared of the withdrawal issues I almost completely thought death would be easier,no one cares at all.
    If I was an addict,I’d be welcome to be admitted for help, but I have real physical issues,our pain clinic pharmacist left,that’s when things went south,primary care physicians don’t have a clue,but pain clinic physicians rip away what works,because they can.
    Instead of helping,they want us to die,especially Vietnam Era,and combat veterans.
    You commented they want us off all narcotic,funny,if you are an employee,you can be prescribed what ever.At this VA,white people rarely get hired,I have been more than qualified several times,passed over for affirmative action; when you’re told oh,it’s not that important you ‘ve been misdiagnosed,you’re only a psych patient.Excuse me,I was tested,my tests were normal,but whatever is written,you become,you’re labeled and too many times I’ve been escorted in handcuffs to the psych ward,when:fxd ribs,3different times,the emergency room physician wouldn’t allow an X-Ray,nurse practitioner,diagnosed me with bronchitis ;it was CHF an HIV patient left blood everywhere,I had to be tested every 3months,but I got blamed because I complained,they said I was racist.the MRI shows he disc yet pain clinic Dr says fibromyalgia.
    Watching nurses curse dementia patients,drag them by one arm down the hall,instead of using a wheelchair?
    PLEASE!!!! Too much has happened,now because I refuse to condone this as OK,I’m now going to have my legitimate pain medication terminated.. what’s wrong with this????

    • The government has managed to circumvent the intent of the statute by insuring no lawyers take cases against the VA in particular and the government in general. Should they do so they find themselves virtual pariahs inside the beltway and have to find work as criminal defense attorneys, ambulance chasers, civil rights attorneys, or any other cause the government doesn’t have hiring power over.

      The VA is vast and powerful and uses their discretionary fund (about half their budget) not to care for patients but to insure that power is not infringed upon, even by those that it is meant to serve. The rot is too deep to consider any action but the preference of criminal charges against the worst of them, and the termination for cause with lose of benefits for the rest for not reporting it. As for the whistleblowers, put them in charge of putting it all back together again, with THEM in charge.

I am in need of legal assistance in regards to not only for the malpractice of the operationon my legg/knee but also the fact that we were told that it would be a very evasive procedure and high intensive pain. Thry assured my wife thai would be provided with a nerve-block to help me with the pain. However, the doctors failed to provide the nerve-block and I suffered excruciating pain. The two doctors also broke my leg during the opreration on April 4, 2014. I still cannot walk and neither one of the doctors have followed with a visit. My wife has tried desperately to contact them but have avoided her requests. We do not understand why they have treatedus in such a demeaning manner. We could really use some legal counsel. Thank you in an advance for your kindness.

  11. Trying to find lawyer who will file a 1151 Medical Malpractice claim against VA for a contractor (fee based) doctor that blotched my surgery. The VA switched me to this second contractor doctor after removing me from my first contractor (fee based) doctor who was to perform the surgery. After the surgery was blotched by the second contractor (fee based) surgery the VA switched me back to the first doctor (fee based) contractor to correct the blotched surgery. I am permanently damaged from the blotched surgery. The second doctor made written verification of the damage.

  12. I went to the Denver VA hospital for an elective procedure for scar revision. Having been burned many years earlier, my scars began to tighten restricting my range of motion. Years after the injury, I had a “Z-Plasty” procedure by a civilian doctor which went well and was effective. I asked my assigned surgeon, Dr. Michael Gordon for that type of procedure. He said that they “don’t do that” and said he’d do another procedure which would work better. I assumed he was a competent professional and entrusted myself to his care. Post Op, I was heavily bandaged and attached to a vacuum device to suck out drainage. I figured this was normal until yesterday, when the bandaging began to fall off and revealed a 36 square inch gaping gash in my neck and chest. I was astounded that this qualifies as medical care. I went outside and walked around in downtown Colorado Springs, and children gasped, grabbed their moms, adults cringed and gaped, and some asked what happened to me. It was traumatizing! Please help me.

  13. I do need help. I have PROOF that doctors at the Ann Arbor VA have FALSIFIED medical records, made False diagnoses of my medical condition. The doctor did NOT know that a BPPV had already been ruled out twice by ENG test and @ Neurologist yet the doctor made a diagnoses of BPPV and he did NOT even know how to do the Dix-Hallpike test. He had my head over the side of the table twisting my head as far as it would go (to the point that it was hurting because of my arthritis in the neck) to the left yelling at me LOOK AT ME, LOOK AT ME!!!

    Then that IS only one of the MANY, MANY problems. They REFUSED to TREAT my SEVERE SLEEP APNEA, After being on morphine for months my PCP decided to just stop my morphine where i went into withdrawal.

    My PCP has been enter LIES into my medical records. She has CONSPIRED with other doctors to prevent me from getting the medical care i need. One doctor told me that my PCP had called her and told her to tell me that my excessive daytime sleepiness was because of the medication i am taking. Yet i have had the problem ALL my life and it has just continually gotten worse. But the point there is that the doctor conspired to tell me that it was because of the medication and the one doctor is so naive that she told me they did.

    My PCP STOPPED my blood pressure medication for NO good reason and i when into hypertensive crisis because of that.

    Then i have PROOF that other doctors have entered FALSE information into my medical records. Like showing that they preformed tests when they did NOT and i have recording to PROVE they did NOT perform the tests.

    So someone please contact me.

  15. I went down at the V.A in San Diego, Ca. for Mental breakdown for being a whistleblower, which I don’t regret. I turned in the Telemerty Techs. in 5south (DOU) for Cardiac Monitoring patient Neglection, never interview still to this day and was awarded a EEO hearing. I’m a fish swimming up stream against the V.A. They’ve hired a Attorney against me, but my spirits continue to tell me to fight on.   16. A doctor at the Boise VAMC misdiagnosed from an XRAY, my Right Wrist as having a ganglion cyst. performed a surgery, found no ganglion cyst but, a bone spur. Surgically removed the bone spur. Right wrist is now weakened and damaged to the point where there is continuous pain and throbbing from my finger tips to my elbow. Right hand can no longer lift or hold onto objects of any weight without excruciating pain since surgery less than two years ago. The same doctor recommended further surgery on my right wrist to correct the 1st surgical malpractice. I need help with this case, please?

  17. It took the VA 8 years to diagnose and treat my ADD. I have failed at 3 careers because of this. I even told the VA doctors that I had ADD and they still refused to treat.   19. I live in northern California and desperately need an attorney! For the past 3 years the V A has denied my son the treatment he desperately needed and was asking for. They have told him that his PTSD was too severe for the Menlo Park residential PTSD treatment program and that he would just need to meet with a V A psychiatrist on an out-patient basis, on another attempt they told him that he needed to get the paranoia under control before he could be admitted into the Martinez residential traumatic brain injury treatment program, and then finally when he managed to get himself up to Medford, Oregon that he needed to attend out-patient appointments and show stability before they would admit him into the White City V A’s residential program. He tried staying in the Medford area (mostly homeless up there), in the hopes that the V A would finally help him. He lost the battle against PTSD, TBI, and his life this past October while still waiting on the V A’s treatment; he was only 25 years old. The V A diagnosed him as being 100% disabled due to PTSD, TBI, etc., yet they repeatedly refused to admit him into a residential treatment program where they could have helped him cope with these illnesses. This has been complete negligence and I have hundreds of emails, documents, etc., to back up my claims. Please let me know of an attorney in northern California that can help us. I want justice done on behalf of my son and I want them to think twice before they close the door to another Veteran who is desperate for help.
