Kenyon Successfully Represents Toyota in Years-Long Patent Litigation

Kenyon & Kenyon LLP successfully represented Toyota Motor Corp. in a long term patent litigation against American Vehicular Sciences (AVS). Originally brought by AVS in the Eastern District of Texas, the matter asserted 24 patents across seven separate cases – accusing essentially every major Toyota vehicular safety system. In the three years since the original filing, the Kenyon team filed 12 separate petitions for inter partes review (IPR) and won a stay in the E.D. Tex. pending resolution of the IPRs. The Patent Trial and Appeal Board granted each of the IPRs, and significant claims were cancelled or dropped. Additionally, the Kenyon team successfully petitioned the Federal Circuit for a writ of mandamus and the case was transferred from the E.D. Tex. to the Eastern District of Michigan, and filed various invalidity summary judgment papers, causing the plaintiff to drop a number of other asserted patents. In May of 2015, the E.D. Mich. granted the plaintiff’s unopposed motions to dismiss with prejudice all of the remaining cases against Toyota. (2015)

New York – April 22, 2004 - Kenyon & Kenyon today celebrated its 125th Anniversary with a spectacular Gala Reception at The American Museum of Natural History.

More than 400 attorneys, guests and New York City Officials attended the historic event in the extraordinary setting of the Hall of Ocean Life. Beneath the Museum’s giant replica Blue Whale, guests were treated to live performances by legendary jazz musician and two-time Grammy award winner Chuck Mangione and his band.

The firm was presented with a Mayoral Proclamation by Commissioner Brian G. Andersson, on behalf of New York City Mayor Michael Bloomberg. Carl Weisbrod, President of the Downtown Alliance, brought special greetings and congratulations to the firm from New York City’s downtown business community. He recognized Kenyon & Kenyon’s historic commitment to downtown New York, it’s renewed commitment since September 11th and managing partner Robert T. Tobin’s strong leadership.

Mayor Bloomberg’s acknowledgement noted, “One hundred and twenty five years after its founding, Kenyon & Kenyon is at the forefront of intellectual property law.” The proclamation continued: “Kenyon and Kenyon has expanded since its days as a five-man firm on Park Place. It is now 200 lawyers strong, and it has opened offices in Washington D.C. and Silicon Valley. Yet even with these changes, and as industries have grown and new ones have developed, it has always possessed the same commitment to its clients that it had 125 years ago, and the same endless spirit that makes New York City the world’s second home.”

Highlights of the evening featured a unique multimedia presentation displaying documents chronicling the firm’s 125-year history, including the original partnership agreement.
