The Act provides for statutory damages of up to $1,000, plus attorney’s fees, for a violation of the law. In cases of extreme harassment, clients can recover even more. For some of our clients, $1,000 is a mortgage payment or two car payments or a month’s utilities and groceries. For someone living paycheck to paycheck, $1,000 can go a long way. Our first step is to meet with you and discuss your situation in detail. It helps if you have made notes and kept copies of all the letters and post cards you have received from the debt collector, so don’t throw anything out or ignore anything. You don’t have to have a recording of the call, but if you do have a recording or voice mail, bring it with you to the consultation. Write down the names, addresses, and phone numbers of anyone you know who is a witness to what has happened. For example, if your neighbor or co-worker received a phone call from the debt collector, please bring his or her name, address, and phone number.
