RICHMOND, VA – Virginia Attorney General Mark Herring unilaterally ended concealed carry reciprocity with 25 states Tuesday, which could effectively deny law-abiding Virginia citizens the right to carry a concealed firearm in those states. Republicans in the Virginia House of Delegates criticized the actions of Attorney General Herring, who repeatedly said he would take politics out of the Attorney General’s office.
“The House of Delegates will immediately begin a careful review of the Attorney General’s findings,” said Speaker William J. Howell (R-Stafford). “Unfortunately, I have little doubt as to his true motivations. Despite promising to take politics out of the Attorney General’s office, Mark Herring consistently seeks to interpret and apply the law of the Commonwealth through the lens of his own personal, political opinions. He is damaging the integrity of the office he holds.”
“This is another Washington-style overreach from a nakedly partisan Attorney General,” said Delegate Rob Bell (R-Albemarle). “The Attorney General’s job is to faithfully interpret and enforce the law of the Commonwealth. Virginians who have concealed carry permits may lose the ability to protect themselves when traveling in 25 states. Instead of doing the job he was elected to do, Mark Herring continues to put the political goals of his liberal supporters ahead of sound legal judgement.”
Speaking about today’s announcement, Deputy Majority Leader Todd Gilbert (R-Shenandoah) said, “Attorney General Herring is endangering the lives of law-abiding Virginians as they travel for work, vacation or to visit their families. Virginia’s law on concealed carry reciprocity was created in 1997, when Democrats controlled both houses of the state legislature. This law gives State Police the discretion to determine the states with which Virginia should have reciprocity agreements based on consultation with the Attorney General’s office. There is no doubt in my mind, however, that the consultation provided by the Attorney General in this matter is based purely on his partisan, political goal of denying law-abiding citizens the right to protect and defend themselves.”
“People who lawfully carry a concealed firearm in Virginia want the confidence that when they travel to another state, that state recognizes the rights of Virginia citizens to protect themselves. The Attorney General’s unilateral action likely means that many of the 25 states involved in today’s announcement will no longer recognize the legal rights of Virginia citizens,” said Delegate L. Scott Lingamfelter (R-Prince William), Chairman of the House Committee on Militia, Police & Public Safety. “If the Attorney General was truly interested in safety and security, he would have sat down with these states and resolved any potential issues instead of pulling the rug from under the feet of law-abiding Virginia citizens.”
Shameful. I hope he knows he will have blood on his hands. The next Virginian that has harm done to him or her while traveling for work or vacations will surely come back 10 fold.

Please get the word out to your family, friends, and neighbors in your community and have them contact the AG, the governor, and the head of the State police to remind them that they work for the citizens of Virginia not anyone else! These agreements have been in place for quite some time. He does not have the right to ignore the will of the people. As an attorney there are other words that I’m sure he’s read in the Constitution but chooses to ignore…..they are ‘…shall not be infringed’.
Fix this in the legislature. Pass a bill similar to North Carolina where concealed carry permits from all states are recognized.
Yes, I wish our representatives in Washington would pass universal constitutional carry or at least nationwide reciprocity, but at least recognize concealed carry, weapons, or handgun permits!

This is utterly disgraceful. Concealed permit holders should enjoy reciprocity in every state that recognizes them. I am ashamed for the first time to be called a Virginian, this state is historically one of the most gun friendly. I blame gov mcawful and his palls that have been greasing his palms since his campaign.

I will use the freedom of Information act to solicit data from Herring on any past problems there have been with CCW permit holders from these other states. I doubt there are any. Join me in making sure that he is never elected to another public office in Va, and encourage your own legislator to help fix the problem herring has caused.

Extremely disappointed in the AG decision to disallow the constitutional rights of all law abiding citizens of Virginia. This is clearly a political decision driven by a specific agenda and does nothing to stop unlawful use of firearms. Once again, I’m extremely disappointed in this decision.

As a 67 year old retired voter I am appalled at the action to cut back the number of states we have agreements with. As a concealed weapons holder for most of my life…my safety is being compromised while I travel.

This is another Obama Puppet. This is unsafe for the law abiding citizens who travel to Va. on business and for pleasure. The police do a great job, but they cannot be everywhere to protect everyone. Just look at the money the state will lose when these people take vacations, etc to other places. I will not travel to another state that will not honor my permit. So what do you think the other states will do? Honor our permits? I don’t think so. Tell him to enjoy his term, because he won’t be there next term.

This is another example of why our constitutional rights should not be ceded to politicians. Support constitutional carry. The Second Amendment should be the only permit required anywhere in the United States. What is he going to take next? Freedom of speech? Freedom of religion? Equal rights for women?
Way to put my family MORE at risk when we travel AG Herring. How often is it that a person who has a CCP from any state is involved in the act of committing a crime? How often does a person with a CCP from any state stop a crime in progress? How often is a police officer there to stop a crime in progress? When are you going to ban knives, as MORE people are killed each year with knives than with shotguns and long guns combined (and yes that means AR style rifles as well)? Don’t believe me? Look it up on the FBI database.
This violation of our rights cannot stand. What can or will the House of Delegates do to stop Herring. An indepth investigation of this matter to include the Superintendent of the Virginia State Police is in order. The intent of the 1997 law provided for the VSP to review these matters and consult with the AG. Why is the AG decision allowed to stand without the concurrence of the VSP?

It appears our Attorney General wants us to join the ranks of the fascist northeast. Mark Herring should know as an elected official, he was given responsibility to protect the rights and interests of Virginians by making sure Virginia statute is enforced. By promoting liberal political agenda, he has broken his oath to all Virginians. As he was elected, so should he be removed.
Like me, many honest and honorable gun owners are “stuck” in Virginia because of family or job. Too, like me, many have relatives who visit from places such as Ohio, Indiana and Florida. Those people spend a lot of money here.
I am able to obtain permits to carry concealed in those states, so I will have no trouble going there to spend my money. I will not ask anyone to come here to visit us, though, until this unacceptable situation is remedied.
This one action has most certainly displeased an enormous swath of the voters.

This unilateral severing of concealed carry reciprocity by the Attorney General is completely inexcusable and misguided. Recent actions by the Governor, and now by the AG, clearly show they are tone deaf and do not understand the difference between a law abiding citizen and a criminal. If these decisions do not get reversed very quickly, these ´public servants´ will have definitively proven they cannot be trusted and must go!

Please put a stop to Mark Herring ending the reciprocity agreement between 30 other FREE states. From what I’ve read the only border state under his plan would include WV. I do frequent WV, put I spend more time (recreate and work) in Tennessee , Kentucky and North Carolina. I have a summer retreat on South Holston Lake which lays in both Va. And Tennessee, my residence is in VA but my summer retreat is in Sullivan County Tennessee. If this is enacted how can I lawfully carry my firearm with me? Sometimes when at the lake I visit a local gun range and carry my firearm under my shirt or in a range bag, both ways are considered concealed. I’m very anxious to hear from you!

Can the House override Herrings decision? Our second amendment rights are trashed to the point where law abiding citizens will have no means of self defense when traveling out of state. I also own property in North Carolina, so this is totally unresonsble to me. I also know that it is more difficult to purchase a gun in North Carolina and from what I understand from friends there, the conceal carry permit is also more difficult. Therefore, I do not believe Mr. Herring did his homework and it is all political.
I expect that the legislature introduce and pass, as one of its highest priorities in the next session, a bill mandating universal recognition of any concealed carry permit of any sort, issued by any jurisdiction in the Union, including territories. And that the leadership do everything necessary to overcome the inevitable veto.
We have decades of proof that people who bother to apply for a concealed carry permit, regardless of how “lax” the standards for issue in their state may be, are less likely to commit crimes than almost any other group of citizens. The current requirement that the VSP and AG decide which states have “worthy” standards for Virginia to recognize a basic civil right is a misguided fantasy, and a ripe opportunity for parisan actions like the Attorney General just undertook.
It is time to end the opportunity for this kind of partisan anti-civil rights bigotry. Universal recognition – itvwont harm the Commonwealth, and it would, in fact, expand the legal rights of residents of the Commonwealth when they travel to other states, as most states only recognize permits from states that have reciprocal recognition .

I am a retired naval officer (US Naval Academy ’77) living in South Carolina. I often travel to Maryland to visit family and fellow alumni. Congratulations! Your state is added to my list of “no-nothing” states, which currently stands at a “dirty dozen”. This is the kind of stuff people like me do not forget. I will make concerted efforts not to spend one thin dime in your state. No visits, no stops, no gas, “no nothing”. I won’t even do internet commerce with companies based in these states. You will remain on this list until such time as I may stumble upon information that restores my right to self defense as I pass through your state. Even then, the damage has been done. Virginia is no longer worthy of my trust.

Attorney General Herring’s decision to unilaterally sever reciprocity with over half our country was both ill conceived, and politically driven. His decision has put many more rational, law abiding citizens at risk to avoid the remote possibility of one of them acting irrational. I am active duty military and a resident of Virginia and my home state. There is a clear and present danger of personal attack to those of us who serve, from radicals. I personally have ccw permits for North Carolina, and Tennennesse and have been exercising my right to carry here in Virginia for over a year now. After Feb 1 2016 my status could change from protector to felon for simply protecting my family as I have done for Virginians overseas, or be forced to spend upwards of $200 for additional in state training and licensing. Severe gun control did not prevent radicals from obtaining fully automatic assault weapons in both recent attacks on the French. Excessive gun control did however slow the response to neutralize that threat. One has to wonder how many lives could have been saved by just one rational, law abiding, armed citizen. In closing if the people’s wish is to disarm reciprocal state ccw holders at least legitimize that motion through there elected representatives and not by New York style secret midnight vote. Thank you for attention to this matter and may justice prevail.
As a person that regularly travels outside Virginia, this new ruling will affect my personal safety. I have always concealed a weapon on my body for personal protection ever since I was caught in between a shootout between two individuals in Pennsylvania. I am constantly in bad locations for work, and not being able to conceal a weapon while i do business in Pennsylvania, NC and SC will now put myself in danger of personal protection.
Does he (Attorney General Mark Herring) actually have the power to unilaterally make this decision?

I am concerned and dismayed that this unconstitutional decree by fiat is being allowed. The headlines report Va. restricts other states. It should read restricts the rights of Virginians to concealed carry outside of it’s borders, as that’s what it effectively does. Traveling our countries highways and being subject to car jacking and robberies while being denied the ability to defend oneself is not appealing.
This law lets criminals know Va. travelers are an easy target outside of our state! Do whatever you can to legislatively stop this!!
We must as a people overturn the decision to not recognize other states concealed carry permits. Through the course of history oppressed people have always had to defend themselves from unlawful physical attacks from criminals and organizations that seek to destroy them and their way of life. This is the United States of America and is not a single State’s determination by one person to determine such action. This decision not to recognize other states concealed carry permits actually supports the criminal element and undermines the lawful ability of the citizen to protect and defend themselves and their families. This should never be about politics or money, furthermore it should never be allowed as a tool to push gun control against law abiding citizens. States Rights vs Federal has always been a contentious issue that has divided this country through its history and has had cascading consequences of an extreme scale. It is in my opinion that all 50 States concealed carry laws be recognized by all states. The required elements for concealed carry should be the same for all 50 states and needs a focus group represented by all states to establish the standard that all 50 states must abide by. Yes it would be a difficult to accomplish but the end goal would be a life saver for the Law Abiding American Citizen.
Why is it that the State of Virginia, in particular the Governor and Atty General, feel it is best and within their authority to make law abiding citizen criminals when a judge has issued us CCPs in our state that will now be useless in adjoining and other states? It is my constitutional right to have a firearm in my possession. Furthermore, a judge has provided a signature that further strengthens that right by allowing me to carry my weapon concealed. Now because of this proposed legislation, reciprocity will be denied in 26 states. So my ability to carry out of my state is being DENIED by the state in which a judge approved my concealed carry status. Why do you politicians feel that YOU have the right to deny my constitutional rights and nullify a judge’s order?
I will now actively participate in any process that will change the politicians that are ruining my state. additionally I will actively make sure that every voter that I come in contact with participates in the next election to ensure that this type of government overreach doesn’t continue. I don’t need the government misinterpreting my constitutional rights. I find it embarrassing that the state in which I live, pay taxes and have raised my family kicks it’s residents in the stomach at every turn to meet some liberal political narrative. As a NC resident whose mailbox is in VA this decision presents real hardship. With this decision I will no longer be able to legally leave my house with a concealed firearm because the state line bisects my driveway. I work in VA, teach firearm safety in VA, compete in around 25 firearm competitions a year in VA, and do most of my shopping in VA but now with this decision I will have to re-think all these actions. I hope the respected legislature of VA is able to push back on this blatant political posturing.
Sir – Thank you for your faithful service to the citizens of the Commonwealth of Virginia. When one holds a carry permit from any state then that carry permit should be held up in Virginia. The only places where we have any problems are gun free zones.

A bill will be introduced in January that will change the law to honor the permits from ALL other states. Last year the same bill cleared the House and was killed in the Senate Finance committee when the State Police lied, saying they would lose money if the bill passed. Please make sure this full-recognition bill passes.

I guess Herring knows he will be a one term AG with moves like this. We should have known what we have when he refused to uphold or defend the gay rights legislation. I am not a Democrat nor Republican, but a PATRIOT. I have voted both ways in the past and can’t believe this! These law abiding citizens probably have already gone through a background check and now are having there rights taken away from them when traveling to another law abiding state. They have a right to defend themselves no matter where they go. This Herring action smells a little fishy. What the hell are we doing to ourselves?
The Virginia Legislature needs to act immediately to reinstate reciprocity and forbid the attorney general from any further attempts to subvert our Inherent rights. Any further attempts of this nature by the Attorney General should lead to impeachment.
There are two bills coming up in the assembly that will make this AG’s decision moot:
HB12 in the House will remove all extra requirements, making VA recognize all out-of-state permits
SB48 in the Senate will finally remove the infringement on everyone’s constitutional right to bear arms by allowing concealed carry without a permit

Mr. Herring needs to worry about real crime. I was not aware that here in Virginia we have had a rash of crime from law abiding gun permit holders from other states. Now he has put my family in danger when we travel across this great country. For the first time I promise to become very active with time and money during the next election.
As a recent new resident in Virginia, having moved from North Carolina where I currently have my Concealed Carry Permit from… I can tell you this is completely a partisan decision. Virginia’s Concealed Carry Permit process is a complete joke compared to what we had to go through in North Carolina. The process in North Carolina takes the better part of a day just to get the class done, in person, with a certified instructor – hands on training, minimum 8 hours. Here in Virginia? You can complete the course less than 10 minutes – Online. Paperwork and background checks are also not comparable – North Carolina’s process requires fingerprinting and a mental health check with prior doctors – Virginia’s does not.
This move by the Attorney General is completely out of line and does not reflect reality. This needs to be opposed and reversed immediately, further because of this and other actions I move that he should be removed from office, immediately on grounds of incompetency.
The AG has brought shame on all law abiding Virginia permit holders and endangered permit holders from other states by this action. The only ones who will not care about this change are criminals so he is also endangering law enforcement officers. Actions needs to be taken now to stop this abuse of due process. The Governor and Attorney General are working in concert to further their wrong-headed ideological agenda that endangers the citizens of Virginia. Not only does the AG’s action against concealed carry reciprocity have a huge negative impact on law abiding citizens, but the Governor has simultaneously decreed that all state government offices are now gun-free zones! That decree (Executive Order 50) endangers tens of thousands of Virginia citizens across the state, including state employees and the general public who receive services at state offices. These actions by the Governor and AG are outrageous and dangerous. I urge our elected representatives in both Houses of the General Assembly to use whatever legislative avenues that are available to them to correct both of these terrible decisions made by the Governor and Attorney General.

I am Active Duty Military Stationed in Minot, ND. I have a Virginia CC permit that was good for me up here in ND and for many of the states that I have to travel to get back to Virginia and Pennsylvania, but now I will have to apply for a CC permit for ND because I have lost my reciprocity with ND and PA. This is just insane to me that this is happening. I am disgusted that for 19 years I have served my country and have been a responsible gun owner and now I virtually have to get a permit from every state that I want to visit or travel through. I have served to try and keep the freedoms of this country and uphold the constitution just to watch them be ripped away by some liberal puppet with an agenda. If there was a time to stand up people it is now, because if they win this one it will not stop here and they will continue to strip our rights away. I am in ND, so I am limited to what I can do, but all of you in Virginia need to stand up and make our voice known, and help rally other states as well, because if this goes through other states with CC privileges and liberals at the helm will suffer the same fate. Since this is a new 2015 law with added “dis-qualifiers” for all Virginia CWPs, I wonder how many of Virginia’s current Resident CWP holders do not qualify for their CWP renewal under the new law?
This would be an excellent FOIA request. The law, 18.2-308.09, identifies 9 dis-qualifiers for any person “obtaining a CWP”. Specifically, False Statement, Non-adjudicatory Mental Health, Juvenile Offenses,Two or more Misdemeanors (Excluding Traffic, but not DWI), Prior Assaults, Endangerment to others, Public Drunkenness (in any State), Drug Offenses, and Deferred Disposition, Drug Offenses.

Please recognized “Reciprocity Agreements” with the above states I recommend that you request all the above states to meet Virginia conceal gun requirements and not cancel the agreements.

I live in Ohio. Our training by what I see exceeds VA’s requirements for a CCW permit. Here, one must do an 8 hour class *in person* with a licensed instructor. 2 hours of that *must* be range time the instructor witnesses. I see in VA that if I take an online course or a hunter safety course (which I don’t believe teaches about handguns per se) I can qualify for a permit if I meet the requirements. I have never gone through Virginia but once (only because I-77 goes from WV to NC through there) to go to Charlotte, NC on vacation. A state that outlaws radar detectors as a way to make money, and who now will make money off people making an honest mistake by simply forgetting their permit isn’t valid and going a short distance into VA, will not ever see me visit ever again. If I go to NC, a state I love as well as Ohio (and where I have some good friends in the mountains), I’ll go via I-75 and I-40 through KY, TN, and NC where my permit is valid and where I’ll be welcomed with my money at local businesses. Sic Semper Tyrannus?? The commonwealth has the wrong motto if they are letting shenanigans like this go on. Shame on you Virginia! Shame, Shame, Shame! (As Gomer Pyle used to say)

Concealed carry holders are law abiding citizens who want to to protect themselfs from violent crime going on in the state. I have wrote letters to my state legislators in opposing this action. If you think this is bad come to my “LESS GUN FRIENDLY” State. You have no idea what restrictions are. I lived in Virginia and was proud to be an american. Now I live in a state and I am cowering for someone to stand up with me against these people. Obama has nothing to lose by using his executive privileges now he is almost out. I feel that Mr. Herring has overstepped his bounds. It is my understanding that it is the duty of the attorney general to advise, uphold, and interpret the state law for the people and organizations. I may be wrong but it is not to change or create laws. Does he think people are going to purchase nonresident permits just to travel thru or visit Virginia? This will not bring money into our state it will cause us to loose money, since people will stop coming here for vacation, shop etc. Not to mention our safety due to other states possibly not accepting our ccp because of revoking repricosity.

By doing this stupid thing and I do mean stupid he does not have the intelligence to see all of the damage he has done to the small businesses and motels restaraunts store gas stations and all the fall out the state businesses will suffer from his actions …motels will lose overnight people that will pass through the state to another better state a much safer state…Travelers wont be able to have overnight lodging in Virginia so motels will stay in North Carolina…lots of truck drivers will now travel through Pennsylvania to tennesee…no more stops for fuel food or lodging…25 states will never again vote for this not very intelligent libtard dumbocrap..
