With the defeat of Japan in 1945, the United Nations developed plans for a trusteeship administration, the Union of Soviet Socialist Republics administering the peninsula north of the 38th parallel and the United States administering the south. The politics of the Cold War resulted in the 1948 establishment of two separate governments, North Korea and South Korea.

The government of South Korea has added stipulations about the pledge of allegiance to its enforcement order for the National Flag Law, which was passed by the National Assembly in January, 2007.

In the Korean legal system, an enforcement order refers to one of the detailed regulations made by the government that narrows the scope of what is permitted by bills passed by the National Assembly. If the enforcement order contradicts congress-passed bills, it has no effect.

The Ministry of Government Administration and Home Affairs on May 3 said, "The National Assembly's committee inspecting proposed bills decided to keep stipulations about the pledge of allegiance from the law itself and instead include them in the law's enforcement order. Public notice has been served that the enforcement order is going to take effect, so we are listening to what the public says before it occurs."

Korea's pledge of allegiance to the flag, or the "Pledge in Front of the Flag" (gukgi ape maengse), which was first implemented by the South Chungcheong Province Office of Education, has been criticized by some that it had totalitarian parts added when the Yusin regime of president Park Chung-hee was created in 1972.

The ministry plans to make a final draft after collecting public opinions until May 13 and then put the matter before the Cabinet next month. The ministry is preparing to make the enforcement order to take effect on July 27 when the law for the national flag becomes effective.

The National Assembly removed the pledge from the proposed version of the National Flag Law last year after the idea of including it sparked controversy. Instead, the Assembly left the problem of whether or not to include it in the enforcement order and any matter concering the wording was left to the ministry. The ministry, however, proposed the enforcement order on April 23 without taking procedures to collect the public opinions, such as performing public hearings and public polls.

Kim Seong-ho, an aide to Rep. Hong Mi-young of the pro-government Uri Party who submitted the bill on the national flag without the pledge in 2004, said, "It would desirable to remove the outdated regulation on saying the pledge.''

"Even if it is included in the enforcement order" he said, "the parts containing the remnants of the military culture forcing loyalty for the dictatorial regime should be changed.''

"Military Socialism" was the term that Francis Bellamy and Edward Bellamy used to describe their dogma. America Pledge originally began with a military salute that was then extended out toward the flag. It was the origin of America's stiff-arm salute, adopted later by the National Socialist German Workers Party, and other.

Kim Sang-bong, a professor at Chonnam National University, said, "The pledge of allegiance aimed at taming many people and making them objects is not appropriate at a time when South Korea is become a multi-racial society. Now is the time to discuss whether to keep the pledge around or not."

The Bellamys wanted government to take over all schools in the USA. When their wish was granted, the government schools imposed segregation by law and taught racism as official policy.  It served as a horrid example for three decades before and through the creation of the National Socialist German Workers' Party. It even outlasted the the NSDAP by more than a decade.

In response, Jeong Ho-yun, an idiotic aide to Rep. Lee Sang-bae of the main opposition Grand National Party (GNP), said, "These days individuals are stressed day by day and the state is losing meaning. The pledge should be maintained to instill patriotism into the hearts of people.''

A pledge to a nation, or a gang oath?

There is a debate going on right now over whether to continue the Gukgie daehan maengse, the "Pledge to the Flag," Korea's version of the pledge of allegiance. That the pledge derived from one that Koreans were forced to recite during Japanese colonial rule and that its current wording is a product of the Park Chung-hee dictatorship and thereby risks being totalitarian is in my view of secondary importance.

The essence of the problem here is that state is forcing people to be "loyal." Is the state something to be loyal to? There is not going to be a correct answer to that question as long as it is left to personal judgment. Whether the state can force loyalty, however, is a different matter. Forcing people to have loyalty towards the state takes the relationship between the state and the citizenry and its reciprocity of rights and obligations and turns it into a hierarchical relationship where the people must live up to all their duties to country. This takes the unique regulatory kind of relationship like that which exists in the military and unduly applies it to the whole population. For this reason, it goes against the basic spirit of the constitution. It also goes against the direction of history, in which the position of those who make up a country has constantly changed. People have elevated their status from feudal subjects forced into loyalty to become modern citizens in a relationship of rights and obligations, and it would be wrong to attempt to turn back history.

In the three versions of the revision to the pledge put forth by the Ministry of Government Administration and Home Affairs, all you find is a people who faithfully fulfill their duty to the state. You do not find a citizenry which asserts its rights. That is because asserting your rights is something that fundamentally does not fit with a format for declaring loyalty. In light of how historically state power has often translated into violence towards sovereign citizens, what is needed instead is a civic spirit that sees the state as an object of control.

Those in favor of the pledge say they are worried about "individualism" on the part of young students these days. However, it would be fatal poison for the health of the community to prescribe collectivism and or nationalism for dealing with individualism. Collectivism is merely an expanded form of individualism. The right approach would be to instill, through history education based on a perspective of peace, the idea that the individual exists in a social relationship and that the state and the Korean people as an ethnic group are one of those relationships, thereby bringing back the spirit of inter-relatedness.

There was a time years ago when teams playing football (soccer) would fight over whether or not a goal was valid if it was made right at 5 p.m., when the whole country was supposed to drop everything and stand still for the pledge broadcast every day. Those times were real tragicomedy forced upon the nation by a modern history full of twisted principles. Today, more than 70 percent of the public supports keeping the pledge, a sad example of the social effects of nationalist education and defining ourselves solely as a country's nationals.

Changes and development in history have come not through the internalization of the spirit of loyalty and obedience, but with a spirit that is free and critical and the courage to question what is assumed to be self-evident. In 1990, the United States Supreme Court ruled that punishing a person for damaging the U.S. flag would damage the precious freedom it is supposed to symbolize. All that you have when the state forces you to pledge loyalty and in a social atmosphere that makes you internalize one-way discipline is freedom's shadow.

Criminal gangs force new members to pledge their loyalty, too. That is surely because you need to disallow criticism through that kind of format if you want to maintain an organization that lacks legitimacy. State philosophy is destitute if it tries to establish the legitimacy of state power the easy way - by forcing a pledge of loyalty instead of by guaranteeing freedom and equality for its members as well as achieving justice through efforts by the state in cooperation with social consensus. The state thirsts after the position of Absolute as it forces people to make its pledge, but to me that attempt looks more like a vision for the state that comes out of a gangster mindset. The pledge takes the citizens for low-level gangsters and as such should be abolished, because that is what would fit with the spirit of the constitution, which declares that it is from the people that the state gains legitimacy for its power and authority.

Many people have marveled at Adolf Hilter's "hypnotic" powers and his propaganda skills, as if he was the first of his kind as head of the National Socialist German Workers Party. Adolf Hitler's propaganda had already been pioneered by Francis Bellamy, Edward Bellamy and American socialists. They put government flags over schools, in classrooms and everywhere. The Pledge is the government's way of telling you that it does not trust you and that it thought you were a liar yesterday when it made you chant about allegiance.  It will feel the same way about you tomorrow when it makes you do it again. And the next day. And so on, and so on.......

In addition to the notorious salute, American socialists (e.g. Edward Bellamy and Francis Bellamy teamed with the Theosophical Society and Freemasons) also bear some blame for the notorious symbol usd by the National Socialist German Workers Party.
