NAIC Responds To Metlife Court Decision

The U.S. District Court's opinion released today confirms what members of the NAIC have long argued: the Financial Stability Oversight Council's (FSOC) designation of Metlife as a systemically important financial institution is flawed.

"State insurance regulators are directly involved in national and international efforts to limit the potential for a financial firm to disrupt the global economy," said North Dakota Insurance Commissioner Adam Hamm, who is also the NAIC's representative on the FSOC. "Too often, discussions regarding systemic threats to the economy don't acknowledge the unique characteristics of the insurance business model or the strengths of our stable state-based regulatory system."

"State regulators serving on FSOC have previously pointed out concerns with its analytical approach, including FSOC's inability to demonstrate that MetLife's failure would disrupt the broader economy," said John M. Huff, NAIC President and Missouri Insurance Director. "Insurance regulators continue to improve our supervisory tools, expanding our abilities to effectively supervise — a job we have done successfully for more than 145 years. While we share the objective of reducing systemic risk, the court's opinion confirms our assertion that FSOC has missed the mark concerning insurance."

NAIC Releases 2015 Annual Report
The National Association of Insurance Commissioners (NAIC) today released its 2015 Annual Report. The report, “To Serve & Protect in the Digital Age,” illustrates how regulators are working together in the ever-evolving high-tech landscape to ensure the success and security of state-based regulation and provide consumer protections.

“This year’s theme demonstrates our commitment to strengthening state-based insurance regulation in the face of cyberattacks and protecting consumer rights,” said John M. Huff, NAIC President and Missouri Insurance Director. “We are constantly working to strengthen the vitality and stability of our system in the face of new challenges such as cybersecurity.”

Hearing on Cyber

NAIC's cyber chair testifies on emerging challenges on cyber insurance issues
North Dakota Insurance Commissioner Adam Hamm testified before Congress today on known and emerging issues impacting cybersecurity in the insurance sector. Testifying on behalf of the NAIC, Hamm, who chairs the NAIC Cybersecurity Task Force, spoke about the importance of keeping consumer data protected as well as the development of a strong cyber insurance market.

"When it comes to regulation, cybersecurity policies are scrutinized just as closely as other insurance products," Hamm said in his testimony.
