RESCHEDULED REGULAR MEETING WAS PROPERLY NOTICED
September 23, 2016
The City of South Heart rescheduled its regular meeting from July 4 to June 28. The city posted notice at the post office and also at city hall, which serves as the principal office of the city council and is the location of city council meetings. The notice was properly posted.

CHARGES FOR LOCATING AND COPYING RECORDS
September 23, 2016
Only after being notified the records were ready did the requester narrow the scope of the request and ask that the copies instead be scanned and emailed. A public entity should be compensated for the time incurred and materials used if copies are made in responding to record requests. The City of Cooperstown did not violate the law when it assessed a charge for locating and copying records responsive to the original request.

MAYOR’S DECISION DID NOT VIOLATE LAW

The City of Williston did not violate the open meetings laws when Mayor made the decision to give a grace period on amendments to city ordinances affecting adult entertainment establishments because the Mayor did not consult any other commissioner before making the decision.

BISMARCK UNLICENSED CONTRACTOR BANNED FROM DOING BUSINESS IN NORTH DAKOTA

A Bismarck man who was the subject of previous consumer fraud investigations has now been banned from doing business in the state, announced Attorney General Wayne Stenehjem. Ryan Dietz, owner of Today’s Homework, has been banned for committing repeated violations of consumer fraud laws.

August 26, 2016
Although personal notice does not necessarily have to be provided in exactly the manner requested, a governing body still has an obligation to provide personal notice containing relevant information from the agenda to those who requested it.
