Industry Notice: Modifications due to the Inauguration Day holiday (01.20.17)
Inauguration Day falls on Friday, January 20, 2017, and is a legal public holiday only for Federal employees who work in the “Inauguration Day area” (defined in law as the District of Columbia, Montgomery and Prince George’s Counties in Maryland, Arlington and Fairfax Counties in Virginia, and the cities of Alexandria and Falls Church in Virginia). (See 5 U.S.C. 6103(c).) As such DDTC offices will be closed on January 20, 2017.
    - The DDTC’s 3:00 PM drop-off/pick-up in the second floor lobby for Friday, January 20, 2017 is cancelled.
    - The DDTC Response Team and DDTC Help Desk will not be taking calls or responding to emails on Friday, January 20, 2017.

Web Notice: USML Category XV Final Rule, effective January 15, 2017, to be published in the Federal Register (01.06.17)
The Directorate of Defense Trade Controls expects to publish a Final Rule in the Federal Register revising USML Category XV soon. The rule is titled Amendment to the International Traffic in Arms Regulations: Revision of U.S. Munitions List Category XV, Public Notice 9688. Once published in the Federal Register, DDTC anticipates this Final Rule will be effective on January 15, 2017. An unofficial copy of the final rule is available here. Please consult the Federal Register for an official copy of the final rule, including its effective date.

Web Notice: Final Rule in the Federal Register (12.29.16)
The Directorate of Defense Trade Controls has published a Final Rule in the Federal Register. The International Trade Data System, Public Notice 9811, is viewable on the Federal Register’s public inspection webpage at https://s3.amazonaws.com/public-inspection.federalregister.gov/2016-31655.pdf. This Final Rule is effective beginning December 31, 2016.

Industry Notice: New Forms and Batch Common Schema (12.16.16)
In support of Federal Register Notices 81 FR 83126, 81 FR 870340 and 81 FR 49531 licensing forms DSP-5, -61, -73, and -85, and the batch Common Schema have been upgraded to accommodate the additions and revisions to USML Categories VIII, XII, XIII, XIV, XV, XVIII, and XIX. Beginning January 3, 2017, DTrade users must use version 9.3 for the DSP-5, DSP-61 and DSP-73 forms, version 3.2 for the DSP-85, and version 7.6 for the Common Schema to submit license applications. Earlier versions of these forms and schema will automatically be rejected by the system beginning on January 3, 2017.

The DTrade application will be unavailable to industry from 6:00PM December 30, 2016 until 7:00AM January 3, 2017 for scheduled system maintenance.

  • Web Notice: Defense Export Control and Compliance System (DECCS) Release #1 Survey (12.15.16)
    On November 21, 2016 DDTC deployed the Commodity Jurisdiction data collection in a web based format in the DECCS environment. DDTC would like to request your feedback and is providing a brief survey to capture all feedback regarding DECCS Release #1 activity.   • Web Notice: Industry users that leverage batch conference call with DDTC (12.09.16)
    Industry users that leverage the batch submission process are invited to schedule an individual conference call with DDTC’s CIO for inquiries and discussion about how the batch process will work with upcoming DDTC changes to its systems and forms in calendar year 2017. Conference calls will be 20 minutes each, with time slots available daily from 11am-1pm EST., starting December 13, 2016 – January 13, 2017.   • Industry Notice: DECCS Scheduled Outages (11.30.16)
    The Defense Export Control and Compliance (DECCS) environment, including the Commodity Jurisdiction (CJ) application, will be unavailable to industry from 6:00PM (EST) to 8:00PM (EST) every Thursday starting December 1 for a regularly scheduled system maintenance window. Please ensure work in progress is saved prior to the scheduled downtime.

  • Industry Notice: Categories VIII/XIX Transition (11.21.16)
    On Monday, November 21st, 2016, DDTC published a final rule implementing revisions to Categories VIII and XIX of the United States Munitions List (USML), pursuant to the President's Export Control Reform initiative (see 81 Fed.Reg. 83,126). This final rule affects, inter alia, a narrow range of articles subject previously to the Export Administration Regulations (EAR) but which will become subject to the International Traffic in Arms Regulations (ITAR) as of December 31st, 2016, the effective date of the final rule. The impacted articles relate primarily to next-generation platforms and will be controlled principally in USML paragraphs VIII(h)(29) and XIX(f)(12). DDTC offers the following guidance regarding licenses or authorizations pertaining to these articles:
        - Effective December 31st, 2016, for articles subject previously to the EAR but now subject to the ITAR under this rule, any unshipped balance under a Department of Commerce authorization will be null and void.
        - Effective December 31st, 2016, the ITAR will regulate the reexport or retransfer of articles subject previously to the EAR but now subject to the ITAR under this rule.

    DDTC expects the scope of impacted authorizations to be limited and will assist exporters in expeditiously obtaining appropriate authorizations under the ITAR. Impacted exporters are encouraged to contact the Office of Defense Trade Controls Licensing through the DDTC Response Team at (202) 663-1282 or DDTCResponseTeam@state.gov. as soon as possible to discuss specific transition impacts.
