HRW prevails in Arizona Supreme Court
December 3, 2010

On May 25, 2010, Adam Weisman argued before the Arizona Supreme Court in Phoenix for the defendant/apellant, Dan Dorsey, in /_Kadlec/Howell v. Dorsey_/. Weisman prevailed, and the Supreme Court vacated the holdings of the Pima County trial court and Division Two of the Court of Appeals, remanding the matter for further proceedings in the Superior Court. The Supreme Court’s Opinion established as the law in Arizona that “the mere creation of a roadway easement does not raise a presumption that the road has been dedicated for public use.
