New Horizons Photo Competition is a ‘Game of Skill’ Competition
Part I – SUMMARY
Competition name: WELLNESS CHALLENGE 2018 NEW HORIZONS PHOTO COMPETITION
Promoter: New Horizons Enterprises Limited (‘New Horizons,’ ‘we,’ ‘us,’ or ‘our’), 15 Twin Road North Ryde NSW 2113, ABN 42 002 066 604.
Entry – residency restriction: Entry is only available to Australian residents
Entry – age restriction: Entrants must be 18 years (or older) on Thursday 24 May 2018
Entry–other restriction: New Horizons staff, agents and anyone else connected with this promotion are not entitled to enter this competition. By entering this competition each entrant confirms that his/her entry is their wholly-owned creation. It is the responsibility of each entrant to ensure that any images they submit have been taken with the permission of subject persons or owners of property and do not infringe the copyright of any third party or any relevant laws.
Competition Period: The competition commences 24/05/2018 at 09.00 am AEST and closes 31/05/ 2018 at 22.00pm AEST, with separate prizes for each ‘Daily Competition.’
The ‘Daily Competition’ Entry Periods will run according to the following schedule:
(a)Day 1: Entry opens 9.00am(AEST) and runs until 22.00pm 24/05/2018
(b)Day 2: Entry opens 9.00am(AEST) and runs until 22.00pm 25/05/2018
(c)Day 3: Entry opens 9.00am(AEST) and runs until 22.00pm 26/05/2018
(d)Day 4: Entry opens 9.00am(AEST) and runs until 22.00pm 27/05/2018
(e)Day 5: Entry opens 9.00am(AEST) and runs until 22.00pm 28/05/2018
(f) Day 6: Entry opens 9.00am(AEST) and runs until 22.00pm 29/05/2018
(e)Day 7: Entry opens 9.00am(AEST) and runs until 22.00pm 30/05/2018
(f) Day 8: Entry opens 9.00am(AEST) and runs until 22.00pm 31/05/2018
How to enter:
At 9.00am AEST on each day of the Competition, the Promoter will announce on its Instagram page a ‘domain of wellbeing’ for the Daily Competition.
To qualify for Entry to the competition, Entrants must:
a) follow the Promoter’s Instagram account: https://instagram.com/newhorizonsau;
b) post an image to the Entrant’s Instagram account that exemplifies the ‘domain of wellbeing’ for that day’s Daily Competition (during the relevant Entry Period – see above)
c) Tag their Instagram photo using the hashtag #wellnesschallenge18 AND the relevant hashtag for the Daily Competition, which the Promoter will announce on its Instagram page each day of the Competition.
All entrants must ensure their entries are posted online during the Daily Competition Entry Period. The Promoter takes no responsibility for any late entries or for any delays or failures in any telecommunications service or equipment. Entries will only be accepted through Instagram #[domain] of wellbeing and #wellnesschallenge18
Entry Criteria: a) being visually captivating and b) thought to be best resembling or embodying of the referenced daily ‘domain’. Please note the wellbeing domains are: Coping, Balancing, Living, Integrating, Physically, Feeling, Independently, Growing and a photo must demonstrate how these domains are being achieved. Are multiple entries permitted? [YES] All entrants may enter as many times as they like but only one prize will be awarded per person.
Receipt of entries: Entries must be received by the Promoter by 22.00pm each day the daily competition runs. Entries uploaded after this time will not be considered.
Displaying entries: The entrant provides a licence for the Promoter (New Horizons Enterprises Limited) to display entries on its website, social media presences, and other marketing material as a condition of entry to the competition, without any further permissions or compensation.
Prize(s): Total prize value is $800 (including GST), eight (8) winners will each receive: 1x $100 Prezzee an e-gift card, branded by the Promoter as a Wellbeing Wallet.
Prize disbursement: Prizes will be distributed to a winner’s supplied email address as a link to download and access the branded $100 voucher via prize distribution partner: Prezzee e-gift cards.
Prize conditions: The prize(s) cannot be exchanged for cash. The Promoter’s decision is final and no correspondence will be entered into. There will be one winner selected each day. Each daily winner will receive a $100 Prezzee e-gift card.
Total number of Prizes: 8
Total Prize Pool: $800
Competition Judging panel will be: The daily Challenge winner will be judged by a panel of three New Horizons Representatives. The judge’s decision is final and no correspondence will be entered into.
Competition Judging will take place at :Judging will take place between 9am – 12pm AEST on the day following each Daily Entry Period. Judging will take place at the promoters head office 15 Twin Road North Ryde NSW 2113
Winner notifications: The daily winner will be posted on the Promoter’s Instagram account URL: https://www.instagram.com/newhorizonsau/ by midday the following day of the daily competition. The daily winner/s will be notified via Direct Message over Instagram between 25/05/18 and 01/06/18 and each winner agrees to supply their personal email address for ease in prize transference.
Winners published: Name/s of winner/s of prizes will be published via the www.mywellbeing.com.au portal for the duration of the competition.
PART II – INTRODUCTION
- Information on how to enter and Prize details form part of these terms and conditions.
- By participating in the Competition, entrants accept and agree to be bound by these terms
and conditions. For the avoidance of doubt, the terms and conditions include Part I, the above summary.
- Entries must comply with these terms and conditions to be valid.
- Where there is an inconsistency between Part I (the summary) and Parts II to XI of these terms and conditions, the summary will prevail.
PART III – PRIVACY
- The Promoter will collect and use each entrant’s personal information for the purposes of:
(a) conducting the Competition (which may include disclosure to third parties for the purpose of processing and conducting the Competition) and for promotional purposes, public statements and advertisements in relation to the Competition;
(b) providing information about the products and services offered by the Promoter and its related companies and its affiliated retailers; and
(c) research to improve its products and services.
- By entering the Competition, entrants consent to the use of their personal information as described in clause 5, above.
- Entrants may access, change and/or update their personal information in accordance with the Promoter’s privacy policy which is available via http://newhorizons.org.au/”.
PART IV – WHO CAN ENTER THE COMPETITION
- If the summary permits entrants to be under the age of 18 years, such entrants must seek permission from their parent or guardian to enter. If the winner of a Prize is under 18 years of age, the Prize will be awarded to the winner’s parent or legal guardian.
- Directors and employees (and their immediate families) of the Promoter or its related companies or agencies and Participating Retailers are not eligible to enter. Immediate families means spouse, ex-spouse, child, step-child, parent, step-parent, legal guardian, sibling or step-sibling.
PART V – HOW TO ENTER THE COMPETITION
- To enter, each entrant must comply with the ‘How to Enter’ section of Part I, the summary. If the summary permits entrants to submit more than one entry, each entry must be unique and submitted separately.
- Entries must not have been published previously or used to win prizes in other competitions.
- An entry cannot be modified after it has been submitted.
- The Promoter reserves the right, at any time, to request verification of the age, identity, residential address or any other information relevant to participation in the Competition of all entrants. The Promoter reserves the right to disqualify any entrant who provides false information or fails to provide information that is reasonably requested by the Promoter.
- The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these terms and conditions or which contravene any applicable laws or regulations.
- The Promoter reserves the right, in its sole discretion, to disqualify any entrant who has breached any of these terms and conditions, has engaged in unlawful or improper conduct or otherwise acts to cheat or undermine the fairness of the Competition by, for example, tampering with, or using or exploiting errors in, the entry process to obtain a competitive advantage over other entrants.
- The eligibility of entries is solely within the discretion of the Promoter.
- The Promoter accepts no responsibility for late, lost, misdirected or damaged entries or other communications.
PART VI – PRIZES
- Each Prize is not transferable, exchangeable or redeemable for cash.
- If a Prize is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Prize with a prize of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority.
- Once a Prize has left the Promoter’s premises, the Promoter takes no responsibility for the Prize being damaged, lost or stolen.
- All taxes (excluding GST, if any) which may be payable as a consequence of receiving a Prize are the sole responsibility of each winner.
- A winner’s use of the Prize is entirely at their own risk. Before a Prize is awarded, a winner may be required to sign an agreement to release the Promoter from and indemnifying the Promoter against any liability arising from the winner’s acceptance and use of the Prize and the winner’s participation in the Competition.
PART VII – HOW THE WINNER(S) ARE DETERMINED
- The Competition is a game of skill. Chance plays no part in determining the winner(s).
- At the time and date specified in the “Competition Judging” section of the Schedule, each valid entry will be judged individually on its merits by the Judges based on the Content Criteria.
- The winning entry or entries will be the entry or entries that best satisfy the Content Criteria, as determined by the Judges.
- The number of winning entries to be selected will be the same as the total number of Prizes specified in the Schedule
- The Judges’ decision will be final and binding and no correspondence with entrants or any other person will be entered into.
- Each winner will receive a Prize.
PART VIII – NOTIFICATION AND CLAIMING THE PRIZE(S)
- The Promoter will provide each winner with instructions on how to claim their Prize. It is the responsibility of each winner to comply with the Promoter’s instructions.
- The Promoter reserves the right to request each winner to provide proof of their identity and/or proof that they were responsible for the winning entry.
- Each winner agrees to participate and cooperate, as required, in all publicity activities relating to the Competition, including, without limitation, being interviewed, photographed, filmed and recorded. Each winner authorises the Promoter to use such content for
advertising and publicity purposes in any media in perpetuity worldwide.
- It is the responsibility of each entrant to notify the Promoter of any change to their contact details.
PART IX – UNCLAIMED PRIZES
- The Promoter will take all reasonable steps to identify and notify each winner in an attempt to ensure that each winner receives their Prize. However, if a winner cannot be identified or does not claim the Prize within three months of the date on which the winners are determined, their Prize is forfeited and will be awarded to the next best entry.
- Each winner of an unclaimed Prize will be determined and notified in accordance with Parts VII and VIII.
PART X – NO LIABILITY
- Any Prize supplied by a third party supplier is subject to the terms and conditions of that third party supplier. Each Prize may come with guarantees that cannot be excluded under the Australian Consumer Law. If those guarantees are not complied with, then you will have rights under the Australian Consumer Law. Subject to those guarantees and rights, the Promoter shall not be liable and excludes all liability (including negligence) for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with the Competition or the use or taking of any Prize except for any liability which cannot be excluded by law including as provided for under the Australian Consumer Law.
- If entry is via Facebook or if the Competition is promoted on Facebook, the Competition is in no way sponsored, endorsed, administered by or associated with Facebook and each entrant agrees to grant Facebook a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:
(a) any information they provide in connection with the Competition is provided to the Promoter and not to Facebook or any other social network; and
(b) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Facebook or any other social network.
- If entry is via Instagram or if the Competition is promoted on Instagram, the Competition is in no way sponsored, endorsed, administered by or associated with Instagram and each entrant agrees to grant Instagram a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:
(a) any information they provide in connection with the Competition is provided to the Promoter and not to Instagram or any other social network; and
(b) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Instagram or any other social network.
- If entry is via Twitter or if the Competition is promoted on Twitter, the Competition is in no way sponsored, endorsed, administered by or associated with Twitter and each entrant agrees to grant Twitter a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:
(a) any information they provide in connection with the Competition is provided to the Promoter and not to Twitter or any other social network; and
(b) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Twitter or any other social network.
- If entry is via Snapchat or if the Competition is promoted on Snapchat, the Competition is in no way sponsored, endorsed, administered by or associated with Snapchat and each entrant agrees to grant Snapchat a complete release from any claims that they now have or may have in the future which relate to or are incidental to the Competition. Entrants acknowledge and agree that:
(a) any information they provide in connection with the Competition is provided to the Promoter and not to Snapchat or any other social network; and
(b) any questions, comments or complaints regarding the Competition will be directed to the Promoter, not to Snapchat or any other social network.
PART XI – TERMINATION OF COMPETITION
- The Promoter reserves the right to vary the terms of, or cancel, the Competition at any time without liability to any entrant or other person, subject to applicable laws.
- The law governing the conduct and operation of this Competition is the law of New South Wales, Australia.
