So far, the FBI report demanded by the Democrats and Jeff Flake hasn’t leaked, But the Democratic Senators who have been shown it didn’t seem to see much they could use in it. So they are reduced to demanding the investigation be lengthened and widened.

Dems, like New Jersey Sen. Bob Menendez, who called the expanded background check a “bullshit investigation,” are using harsher language about the FBI than Trump ever did.

No, it’s all ovah. They would look truly pathetic. It is sort of like going into the 5th overtime in a wrestling championship: you gotta be young and fit. Those Democrats look completely wasted. Turns out Flake’s proposal for an additional FBI investigation was a good idea for the Republicans.
The additional week:

- Took advantage of the short attention span of most voters who no longer care about this

If it’s Amy Coney Barrett nominated to replace Ginsberg, it’s going to be another bloodbath.
The theme will be separation of church and state, because Barrett is not only a devout Roman Catholic, but belongs to a charismatic parachurch group called ‘People of Praise’ that advocates male headship/women as ‘handmaidens’. It has the potential to be even more bitter than this one.

Not surprising. I mean, what was there to investigate? There’s no forensic or DNA evidence in play. That leaves witnesses and if the Democrats had any good ones we’d already know about them.
At this point they seem to be pivoting to saying the investigation must be extended indefinitely, that Kavanaugh supposedly perjured himself by downplaying his drinking, or that Kavanaugh lacks the appropriate “temperament” since he had the nerve to get indignant when they launched their smear campaign. Complete desperation. And transparently dishonest.

I could do without a hard-core mystic on the SCOTUS but I am interested on what the Dem’s 11th hour play on Barrett’s nomination would be. I doubt alcoholic, frat boy, rapist will work on her.
Barrett was Trump’s trump card, which he held, in this deal. The poker analogy doesn’t work well because he turned over all his cards at the start. But I think Trump had a “go ahead and raise me if you dare” poker strategy in mind with the Barrett card face up and unplayed on the table.

Yes, the Dems thought keeping it in the news another week would be to their benefit. But that was only going to be the case if the FBI found dirt on Kavanaugh, because it probably would’ve delayed confirmation of a new nominee until after the election.
But the increasingly desperate effort to smear Kavanaugh only served to remind people of how awful, anti-white male the Democrats have become and helped to increase enthusiasm among Republican voters. The Dems are like some half-wit gang of terrorists who filled their car with explosives only to have it blow up no one but themselves, and take half their mosque with them.
FOX is reporting that the FBI report is a thousand pages long, FWIW.

The way Steve describes it, this investigation is the Democrats’ main thrust, so naturally they want it longer and wider. They’re not happy being stumped.
Here’s a thought someone with some trolling skills should convince NPR to bring on some Muzzie to recite the “holy quaran” . That is if they haven’t already .
Actually if you were going to oppose Judge K., the best issue to do so would be his temperament at the hearing. Trying to base it upon his record or his college drinking days is a no-go. Ironically it was the democrats’ shit test of him that brought out an anger in him that was unbecoming a SC justice.
As for me I want him confirmed just because we are in a culture war and we cannot allow the left to behave like they have and win. However, if this was still the America of yesteryear, I’d question whether he really did have the temperament to be on the SC. Now I will take a right-wing partisan because we so desperately need to roll back the rot. But in another time and place, I’d not vote for him based upon his demeanor.
That’s why he was the last one. Maybe once he’s gone to his just reward we can get another chance to redeem ourselves.
I think the democrats need to learn that an old sexual assault charge is hard to prove especially when the alleged victim never reported it to the authorities or told anyone for 30 some years. In the end this proved too difficult to make stick because Kavanaugh had too good of a reputation. It might have worked on Judge Moore last year, but that was partially because Moore seemed too kooky for most people. Judge K. does not.
In the future I suggest the democrats just bring someone forward who will claim that a republican senate candidate, SC justice nominee or fill-in-the-blank called someone the N-word years ago. Given that this was not a crime until about 10 years ago, there would have been no reason to report said infraction to the authorities 30 years ago, so the lack of a police report would not be a show stopper. I think this would be much harder for the person to deny, because let’s face it, pretty much all whites who are over 30 years of age have most likely used the N-word in private among friends. The guy would basically have to admit that was the language he used in high school, and he is not proud of it. It would be much tougher to stay in the race once that happened.

Furthermore, as a practicing criminal trial lawyer, I would add that the “judicial temperament” argument the Dems are playing up is a load of crap. I have seen some very good trial judges go off on attorneys who show up to court unprepared in a manner that would make a a lot of people cry.
I think it is totally appropriate for a judge to do this. It is disrespectful to the court and the legal profession to show up to court unprepared. The notion that judges should sit on the bench and never show any emotion is ridiculous.
What the Dems tried to do to Kavanaugh is far worse than anything I have ever seen from an incompetent or unprepared attorney in a court room. Kavanaugh reacted exactly as he should have.

Think of it this way. When they recruited the Mercury 7 astronauts they did not take the 7 best pilots. They did not take the 7 smartest engineering minds. They did not take the 7 most physically fit men. They had to take the 7 guys that were the complete package. You need the guy with ice water in his veins who is not going to be rattled no matter what happens.
Recall the Apollo 13 mishap. The guys on board were cool as ice as they methodically followed instructions to troubleshoot the myriad of problems on that mission. There were moments on that flight were the odds were great that they would never see their families again and would be marooned in space. Yet they never broke down.
I am not saying it’s easy to do this. I cannot do that. I would lose my temper for sure. But then again I am not trying to become a Mercury 7 astronaut or a SC justice.
Judge K. got a raw deal. He has every right to be angry. But a SC justice must be able to detach himself from emotions.

Federal appellate judges are up in the clouds debating textual minutiae and broad policy with their law clerks and other judges. They don’t need any particular kind of temperament.
Why? Where does that come from? Ever had recordings of their sessions? We’re not talking about a test pilot, surgeon, EMT, or cop here. There is no rush or emergency, to ensure that they have time to consider things thoroughly. They deliberate, sitting at table or desk, sometimes over days. Should they also be able to re-assemble a stripped rifle in the dark?

If you follow things on Twitter, it looks like this confirmation is still up in the air, and is by no means a sure thing. They have a cloture vote tomorrow with up to 4 Republican Senators who are unknowns (Collins, Murkowski, Sasse, and Flake), and Joe Manchin as the only Democrat “maybe” left. Flake has still been a weak sister today having “issues” and wanting to talk to Chris Coons. And Sen. Steve Daines (R-MT) is away on Saturday for his daughter’s wedding.
Democrats and the Left are pulling out all the stops and not caring how insane they look anymore, with the WaPo editorial page issuing its first “no” recommendation since Bork, the list of law profs signing against Kavanaugh up to 2,400 now, over 300 arrests of protestors in DC today, and that creepy Democrat staffer who was doxxing Republican Senators (and apparently threatening to doxx their kids too). I wouldn’t be surprised if there’s something else tomorrow morning to try to scotch the cloture vote at the last minute. This really is the hill the cat-lady Dem base is prepared to die on.

There was that woman who was under consideration. Nominating her next could work out very well.
Feinstein was a real looker in her youth. She still looks great for an 84 year-old, great bone structure.
The only thing I like about Kav is his very limited record on immigration. Other than that I can take him or leave him. He’d better not let us down on immigration if he gets confirmed. Never much care for RINO’s position on abortion and guns. I’m willing to let the Dems have those 2 as long as we get a judge who’s super tough on immigration. Unfortunately I don’t think such a judge exists.

Kavanaugh has limited record on immigration, but they were good:
1) Ruled against an illegal saying labor law does not protect illegals because they already broke the law by being in the country illegally.
2) Ruled against restaurant chain Fogo de Chao when they wanted to bring in a Brazilian “chef” to work in their restaurant and the visa app was denied. They tried to appeal. Kav said being a chef in a Brazillian grill does not take any special skills, plenty of Americans can do the job, employer just wants cheap labor.
3) Ruled against an illegal teen who wanted to leave detention to get an abortion. Although that one might just be because of his stance on abortion.

There is no correct demeanor when it comes to being a victim of rape. as we’ve come to learn. If someone needs to cry, scream, be passive, curl up in a fetal position — so be it. Like the stages of grief, any or all of those responses may be appropriate at some point, or at least understandable, and they are not for outside observers to judge or nitpick.
The same decency and leeway should be granted to those falsely accused of rape. There is no rule book on how one should behave when being made out to be a gang rapist, so maybe people should stop pretending he violated one.
The supreme court is not flight test, and it isn’t even like being an astronaut. A justice does not have to make split second decisions, does not have to execute complicated physical tasks and can consistently rely on help from his clerks, or anyone in the world at all.
Also, per Tom Wolfe, the Mercury 7 were chosen because they were the most marketable and most in line with the desired “image” that the government wanted to project. Now we all know about Griggs v Duke power, but I’m going to say that if they had not insisted on college degrees for the astronauts, if Chuck Yeager had the profile of John Glenn, we’d be in a very different boat right now.
Anyway, me, I want a guy on the supreme court who gets angry, goes into a rage, and destroys our enemies.
Now, if I’m being honest — and this is among friends, here in our safe space — his temper at the hearing came off whiney to me. He kept repeating “this was sprung on me!” As if he was told by the teacher that he would always know ahead of time when there was going to be a quiz, and then suddenly there was a pop quiz. He was given assurances he would have time to prepare for the attacks! I was waiting for him to say “it’s not fair!” He came off a little bit like Hillary in 2008 (and 2016, lol) , like he was like but but its MY TURN, i’m SUPPOSED to be on the Supreme Court, EVERYONE SAID!!

Seems plausible enough. I’m just guessing the vote will be tight. Flake is not to be counted on, IMHO, and if Manchin is a “no,” that leaves a 50-50 vote. We’ll know more tomorrow morning.
This whole theater is really for the benefit of two female Republican senators. Quite frankly, I’m not all that bullish on Kavanaugh’s chances of getting voted onto the Supreme Court. Murkoski spent today in Alaska allowing herself to be lobbied by a group of 18 alleged sexual assault survivors who all oppose Kavanaugh for some delusional reason or other. Kavanaugh may not be a rapist in fact, but the media has now made him an honorary one. How dare he defend himself and not submit to the summary judgement of shrieking pussyhat harridans.

I think this attention span idea would be very useful to corporations and universities if they weren’t already bought into social justice. For instance, Starbucks could have asked an external law firm or consulting company (not diversity related) or such to do a very, very, very thorough “investigation” and report back to the board in two months. By the time they got the report only Daily Kos is paying any attention. The other advantage, besides delay, is that you’d get a real investigation, finding, for instance, that the “noose” on the tree was probably a hoax. Or Starbucks would find out the details behind why the black guys showed up to begin with.
At most law schools, “first in the class” does mean the best grades. The only problem is that there can be multiple people with perfect grades these days.
At places like Berkeley Law, with loosey goosey psychedelic era grading systems, Pass, Honors, High Honors, they still have numeric grades that they do not reveal publicly, for doing these rankings.
Without such rankings law schools have trouble placing law clerks, and “number of law clerks placed in which courts” is a big law school metric.
“Cool under pressure” isn’t really necessary for a judge. Their work isn’t time-sensitive.
What you want, really, is “doesn’t cave under pressure”.

Listen. I didn’t cry when my father died. I am so f–ing stoic that a surgeon told my wife to relay to me that “John Wayne is dead” (she brought me to the ER after I experienced a few days of excruciating pain, which I thought I’d handle with Ibuprofen – he told me that I’d have died within 24 hours if left untreated and marveled at how I did not cry out or pass out from that extreme pain).
But even I do shed a tear or two when 1) one of my dogs dies and 2) a daughter of mine – one of the little ones in my brood who wants to grow up to be a martyr for her Catholic faith – shows an act of utter selflessness that it takes my breath away. When Judge Kavanaugh briefly mentioned that his 10-year old daughter suggested that they pray for Ford and he choked up, and I completely, totally understood his emotion. It is both from the gratitude for the pure goodness that is the innocent devotion of a child and also from the shame that a sinner is undeserving of such a precious gift.

Historically, women were always part of family units that kept them under control (this BTW was a two way street and not just “patriarchy” – often the woman had control of dad’s pay packet so that he wouldn’t drink it all up at the saloon). When they were younger their dads and brothers served as a brake and later their husbands and their responsibilities to their children. But these women have only their cats and their box wine so when they go off on a mental tangent or start hitting the snacks or going on a different Tinder “date” every night there is no one to stop them. Humans are not really meant to live in isolation like this.
Serious countries do not permit themselves to be ruled by the cries of hysterical women. This is not to say that women need to be excluded from participation in civic life. I agree. I’m Catholic but obscure Catholic sects (People of Praise?) make me uneasy and with her seven kids she comes across, without me knowing anything else about her, as ‘religious kook’. I looked into her family structure and find it a little troubling. Her seven kids range from 16 to 5: 16 yo female, 13 yo female (Haitian), 13 yo female, 10 yo male (Haitian), 8 yo male, 6 yo male, and a 5 yo male with special needs. She’s 46 now so she had her last two at 40 and 41. Since she’s an uber-Catholic and has seven kids, I assume she and her husband followed natural family planning but in this day and age of basal body thermometers, ovulation kits, and apps there is no reason to guess at your fertile phase and be able to avoid it. I also expect a pair of high-level professionals to plan their kids out better and show some restraint, no matter how religious they are. Seven is a lot to handle and parse out attention to.

I’m not particularly pro-Barrett, but the involvement of women in the public sphere is much more of a problem as a mass phenomenon than an individual one. Leaders are, after all, outliers more or less by definition – as such they can be judged by their individual merits, even if their groups of origin are rather terrible. A simple thought experiment (society with female leaders but no female voters vs the reverse) should probably tell you which would lead to the better outcomes and what therefore is the greater problem. It’s female followership (ie mass influence, eg as voters) more than leadership at issue IMO.

As a public employee I was released from work when it was announced that the jury had reached a verdict. (An hour before the verdict was read.) I think the compromise verdict is being widely, albeit reluctantly, accepted.

Result–a great one. By the time a year had gone by no one could really remember what George had allowed or disallowed, and everyone thought they had won, bar a few people on each side who actually knew what the issue was about, who were statistically insignificant.
And even if they didn’t like it, the man had spent so much time on his knees praying about it, and even more time telling people about the praying, that you could hardly hold him personally responsible. It was in God’s hands. And since God practically invented the science of genetics single-handed (actually left-handed, since Jesus was sitting on his right hand at the time) you could hardly blame human beings for a spot of work on improving some aspects of the Creation where God seemed to have whiffed. It is the least man can do to return the favor for being created in the first place.
