So far, the FBI report demanded by the Democrats and Jeff Flake hasn’t leaked, But the Democratic Senators who have been shown it didn’t seem to see much they could use in it. So they are reduced to demanding the investigation be lengthened and widened.

So, something bad will happen to them if they delay anymore: they should fear the public.

    The additional week:
    - Cooled the national temperature down
    - Took advantage of the short attention span of most voters who no longer care about this
    - Made Democratic claims of an incomplete investigation look like the partisan ploy it is

    If it’s Amy Coney Barrett nominated to replace Ginsberg, it’s going to be another bloodbath.

    The theme will be separation of church and state, because Barrett is not only a devout Roman Catholic, but belongs to a charismatic parachurch group called ‘People of Praise’ that advocates male headship/women as ‘handmaidens’. It has the potential to be even more bitter than this one.

    Not surprising. I mean, what was there to investigate? There’s no forensic or DNA evidence in play. That leaves witnesses and if the Democrats had any good ones we’d already know about them.

    At this point they seem to be pivoting to saying the investigation must be extended indefinitely, that Kavanaugh supposedly perjured himself by downplaying his drinking, or that Kavanaugh lacks the appropriate “temperament” since he had the nerve to get indignant when they launched their smear campaign. Complete desperation. And transparently dishonest.

    I could do without a hard-core mystic on the SCOTUS but I am interested on what the Dem’s 11th hour play on Barrett’s nomination would be. I doubt alcoholic, frat boy, rapist will work on her.

    Barrett was Trump’s trump card, which he held, in this deal. The poker analogy doesn’t work well because he turned over all his cards at the start. But I think Trump had a “go ahead and raise me if you dare” poker strategy in mind with the Barrett card face up and unplayed on the table.

    Yes, the Dems thought keeping it in the news another week would be to their benefit. But that was only going to be the case if the FBI found dirt on Kavanaugh, because it probably would’ve delayed confirmation of a new nominee until after the election.

    But the increasingly desperate effort to smear Kavanaugh only served to remind people of how awful, anti-white male the Democrats have become and helped to increase enthusiasm among Republican voters. The Dems are like some half-wit gang of terrorists who filled their car with explosives only to have it blow up no one but themselves, and take half their mosque with them.

    Actually if you were going to oppose Judge K., the best issue to do so would be his temperament at the hearing. Trying to base it upon his record or his college drinking days is a no-go. Ironically it was the democrats’ shit test of him that brought out an anger in him that was unbecoming a SC justice.

    As for me I want him confirmed just because we are in a culture war and we cannot allow the left to behave like they have and win. However, if this was still the America of yesteryear, I’d question whether he really did have the temperament to be on the SC. Now I will take a right-wing partisan because we so desperately need to roll back the rot. But in another time and place, I’d not vote for him based upon his demeanor.

    I think the democrats need to learn that an old sexual assault charge is hard to prove especially when the alleged victim never reported it to the authorities or told anyone for 30 some years. In the end this proved too difficult to make stick because Kavanaugh had too good of a reputation. It might have worked on Judge Moore last year, but that was partially because Moore seemed too kooky for most people. Judge K. does not.

    In the future I suggest the democrats just bring someone forward who will claim that a republican senate candidate, SC justice nominee or fill-in-the-blank called someone the N-word years ago. Given that this was not a crime until about 10 years ago, there would have been no reason to report said infraction to the authorities 30 years ago, so the lack of a police report would not be a show stopper. I think this would be much harder for the person to deny, because let’s face it, pretty much all whites who are over 30 years of age have most likely used the N-word in private among friends. The guy would basically have to admit that was the language he used in high school, and he is not proud of it. It would be much tougher to stay in the race once that happened.

    I respectfully disagree. You are parroting the Democrat line.

    Kavanaugh was put in a double bind: maintain proper demeanor and allow yourself to get beat up and your country’s mores to be destroyed, or fight back with proper vigor.

    His behavior made me and millions of other Americans like him more.

    We have to let men be men. That includes rightful anger as well as boyhood shenanigans.

    If we continue to cut off our balls in the name of not offending those who already hate us, we will all be wearing pussy hats when the Chinese foreclose on our homes, Affirmatively Furthered blacks move into our towns at our expense, and Pakistanis come and pimp out our daughters.

    Furthermore, as a practicing criminal trial lawyer, I would add that the “judicial temperament” argument the Dems are playing up is a load of crap. I have seen some very good trial judges go off on attorneys who show up to court unprepared in a manner that would make a a lot of people cry.

    I think it is totally appropriate for a judge to do this. It is disrespectful to the court and the legal profession to show up to court unprepared. The notion that judges should sit on the bench and never show any emotion is ridiculous.

    What the Dems tried to do to Kavanaugh is far worse than anything I have ever seen from an incompetent or unprepared attorney in a court room. Kavanaugh reacted exactly as he should have.

    Bork was 30 years ago. The rot was already set in place then. I think you have to go back further, before my time, to find that America that no longer exists.

    Being angry is not the problem. Showing anger in public, weeping in public and sounding partisan are the problem in my book. We are talking about being one of the nine members of the SC.

    Think of it this way. When they recruited the Mercury 7 astronauts they did not take the 7 best pilots. They did not take the 7 smartest engineering minds. They did not take the 7 most physically fit men. They had to take the 7 guys that were the complete package. You need the guy with ice water in his veins who is not going to be rattled no matter what happens.

    Recall the Apollo 13 mishap. The guys on board were cool as ice as they methodically followed instructions to troubleshoot the myriad of problems on that mission. There were moments on that flight were the odds were great that they would never see their families again and would be marooned in space. Yet they never broke down.

    I am not saying it’s easy to do this. I cannot do that. I would lose my temper for sure. But then again I am not trying to become a Mercury 7 astronaut or a SC justice.

    Judge K. got a raw deal. He has every right to be angry. But a SC justice must be able to detach himself from emotions.

    As I said, I don’t really care anymore. It’s too late now for such standards. I’ll take a rabid right-wing partisan on the SC any time I get the chance. If I had my way Patrick Buchanan would be on the SC.

    Why? Where does that come from? Ever had recordings of their sessions? We’re not talking about a test pilot, surgeon, EMT, or cop here. There is no rush or emergency, to ensure that they have time to consider things thoroughly. They deliberate, sitting at table or desk, sometimes over days. Should they also be able to re-assemble a stripped rifle in the dark?

Flake has still been a weak sister today having “issues” and wanting to talk to Chris Coons. And Sen. Steve Daines (R-MT) is away on Saturday for his daughter’s wedding.

    Democrats and the Left are pulling out all the stops and not caring how insane they look anymore, with the WaPo editorial page issuing its first “no” recommendation since Bork, the list of law profs signing against Kavanaugh up to 2,400 now, over 300 arrests of protestors in DC today, and that creepy Democrat staffer who was doxxing Republican Senators (and apparently threatening to doxx their kids too). I wouldn’t be surprised if there’s something else tomorrow morning to try to scotch the cloture vote at the last minute. This really is the hill the cat-lady Dem base is prepared to die on.

    As for “temperament” as a qualification, I feel we should have learned back in the days of Obama (“a first-rate temperament” per Chris Buckley) that it’s content-free: just an important-sounding but empty compliment. Pretty faint praise, really.

    There is every indication in his 27 year long professional record that he is, in fact, very good at doing just that.     1) Ruled against an illegal saying labor law does not protect illegals because they already broke the law by being in the country illegally.

    2) Ruled against restaurant chain Fogo de Chao when they wanted to bring in a Brazilian “chef” to work in their restaurant and the visa app was denied. They tried to appeal. Kav said being a chef in a Brazillian grill does not take any special skills, plenty of Americans can do the job, employer just wants cheap labor.

    3) Ruled against an illegal teen who wanted to leave detention to get an abortion. Although that one might just be because of his stance on abortion.

    The supreme court is not flight test, and it isn’t even like being an astronaut. A justice does not have to make split second decisions, does not have to execute complicated physical tasks and can consistently rely on help from his clerks, or anyone in the world at all.

    Also, per Tom Wolfe, the Mercury 7 were chosen because they were the most marketable and most in line with the desired “image” that the government wanted to project. Now we all know about Griggs v Duke power, but I’m going to say that if they had not insisted on college degrees for the astronauts, if Chuck Yeager had the profile of John Glenn, we’d be in a very different boat right now.

    OT Point – In “life is always high school” news, did anybody check out the feeds of the girls protesting in the senate?     Kavanaugh was smart, high energy (physical not social), hard working, very well organized, ambitious and relatively athletic. There is no evidence that anyone considered him intellectually exceptional at Yale or that his grades were extremely high. He said that he got into Yale Law School by “busting his tail” in college. Sotomayor, too, was a grind.

    I think this attention span idea would be very useful to corporations and universities if they weren’t already bought into social justice. For instance, Starbucks could have asked an external law firm or consulting company (not diversity related) or such to do a very, very, very thorough “investigation” and report back to the board in two months. By the time they got the report only Daily Kos is paying any attention. The other advantage, besides delay, is that you’d get a real investigation, finding, for instance, that the “noose” on the tree was probably a hoax. Or Starbucks would find out the details behind why the black guys showed up to begin with.

    At most law schools, “first in the class” does mean the best grades. The only problem is that there can be multiple people with perfect grades these days.

    At places like Berkeley Law, with loosey goosey psychedelic era grading systems, Pass, Honors, High Honors, they still have numeric grades that they do not reveal publicly, for doing these rankings.

    Without such rankings law schools have trouble placing law clerks, and “number of law clerks placed in which courts” is a big law school metric.

    Listen. I didn’t cry when my father died. I am so f–ing stoic that a surgeon told my wife to relay to me that “John Wayne is dead” (she brought me to the ER after I experienced a few days of excruciating pain, which I thought I’d handle with Ibuprofen – he told me that I’d have died within 24 hours if left untreated and marveled at how I did not cry out or pass out from that extreme pain).

It is both from the gratitude for the pure goodness that is the innocent devotion of a child and also from the shame that a sinner is undeserving of such a precious gift.

    But that wasn’t the only time he wept. He continued even after that part of his opening remarks. I think it made a poor impression upon me because I was listening to it on the radio in my car. Listening on the radio gives one a different perspective than watching it on TV.

    I recall back in 2000 when Al Gore was debating Bush, Gore made these heavy sighs when Bush struggled to put together a sentences during one of their debates. I was listening to it on the radio and Gore’s sighs came across very loud and made him seem like a prick.

    You need to watch the entire proceedings, starting from the first minute, so you get the build up of emotions. Watching a highly accomplished grown man, who looks like he could be your next door neighbor, driven to lose his composure like that was a gut punch to a lot of Americans. Kavanaugh’s authentic emotion kicked off the red wave that is going to happen in November. If he had been a cool cucumber the public would have thought he was guilty.

The Left’s misstep is not that they targeted Kav per se, but that they did so in a way that could apply to any American male who ever paid attention to—or even ignored—a girl in his teenage years. They realized this new “she said, and he can shut up” standard made them as vulnerable to MeToo-ing as a cad like Weinstein.

    Historically, women were always part of family units that kept them under control (this BTW was a two way street and not just “patriarchy” – often the woman had control of dad’s pay packet so that he wouldn’t drink it all up at the saloon). When they were younger their dads and brothers served as a brake and later their husbands and their responsibilities to their children. But these women have only their cats and their box wine so when they go off on a mental tangent or start hitting the snacks or going on a different Tinder “date” every night there is no one to stop them. Humans are not really meant to live in isolation like this.

    Serious countries do not permit themselves to be ruled by the cries of hysterical women. This is not to say that women need to be excluded from participation in civic life. They can participate, but only if they are willing to participate on the same basis as men and not as some special privileged class whose victim status morally elevates them and excuses them from the rules of civilized behavior, from burdens of proof, etc. Otherwise we are doomed.

    The victimhood of these women is mostly in their head anyway – they are for the most part pampered and privileged (at least materially – emotionally they are clearly deprived) and only want to get in on the victim racket because women are status seeking and the highest status today (an almost holy or saintly status in their secular religion) is afforded to victims. These female “rape” victims like Chrissy and Jackie are the modern equivalent of the girls who used to have visions of the Virgin Mary or the girls who were the witnesses at the Salem witch trials.

    If we were to apply the principles of political correctness as to demographic representation, the 9 judges on our Supreme Court would comprise:

    2 Catholics
    5 Protestants

    All other religions are of such small proportion that they would not even merit representation.

    I agree. I’m Catholic but obscure Catholic sects (People of Praise?) make me uneasy and with her seven kids she comes across, without me knowing anything else about her, as ‘religious kook’. I looked into her family structure and find it a little troubling. Her seven kids range from 16 to 5: 16 yo female, 13 yo female (Haitian), 13 yo female, 10 yo male (Haitian), 8 yo male, 6 yo male, and a 5 yo male with special needs. She’s 46 now so she had her last two at 40 and 41. Since she’s an uber-Catholic and has seven kids, I assume she and her husband followed natural family planning but in this day and age of basal body thermometers, ovulation kits, and apps there is no reason to guess at your fertile phase and be able to avoid it. I also expect a pair of high-level professionals to plan their kids out better and show some restraint, no matter how religious they are. Seven is a lot to handle and parse out attention to.

    First, Reagan and Thomas did not cry. As I mentioned above I don’t like to see grown men cry in public. Mount a stiff defense, but stop the weeping.

    Second, I recall Thomas using the ‘high-tech lynching’ metaphor, but I don’t recall him specifically singling out democrats. Defend yourself. But don’t become politically partisan in doing so given the job you are in line to get.

    Third, along the lines of the above I am still scratching my head at why the GOP Congress won’t impeach Justice Ginsburg over her public, political comments against Trump. At the very least she should be forced to recuse herself on any cases involving the Trump administration and its policies.

    Sorry, I didn’t mean to demean anyone’s faith, but it’s hard for me to say that women who have visions of imaginary rapes are just delusional but shepherd girls who have visions of the Virgin Mary are the real thing. Every faith is based on .. uh .. faith but when it’s not your faith I think it is OK to be skeptical that Mohammed really flew to Jerusalem on his horse or that the Angel Moroni really hung around upstate NY in the 19th century.     Haitian babies that are adopted acquire US citizenship on adoption and grow up as Americans.

Humans will feel and fantasize as long as there are any – no matter where. And – that’s the cultist part of it, they will shape these fantasies collectively.   291. One thing about Brett Kavanaugh that I don’t know if anyone else has mentioned: He is not an intimidating guy. All the accusations of bullying, being a jock, picking on people, etc. just don’t ring true.

    To me he is a rather ordinary-looking, pasty-faced fellow, now and in old school photos. All that talk about lifting weights and playing sports doesn’t change the fact that I can’t see myself or my science-oriented school friends ever having been intimidated by him.

    Of course, my high school experience was cut short, and I went to a relatively small school where things were more like what some here have described, devoid of the stupid high school stereotypes and dynamics. (Trey Parker of South Park fame went to the same mountain school a few years later.) The quarterback might have been your pal from calculus class, and you might have dated a cute girl even though you were a STEM kind of guy. And if you were a STEM guy, you probably climbed mountains anyway. We had very few nerds or geeks, but a lot of smart people who became very successful.

    Whatever jerks I remember tended to be hyper-masculine types and not terribly promising. The worst thing that ever happened to me was when a future Annapolis midshipman knocked my books off my desk. Nothing happened after that.

    Kavanaugh doesn’t even have a deep voice. He is still boyish.

    Conservatives tend to be nicer people than left wingers.

    I’m not particularly pro-Barrett, but the involvement of women in the public sphere is much more of a problem as a mass phenomenon than an individual one. Leaders are, after all, outliers more or less by definition – as such they can be judged by their individual merits, even if their groups of origin are rather terrible. A simple thought experiment (society with female leaders but no female voters vs the reverse) should probably tell you which would lead to the better outcomes and what therefore is the greater problem. It’s female followership (ie mass influence, eg as voters) more than leadership at issue IMO.

    I’m no expert in this area, but it’s my understanding that the Church hierarchy usually starts out treating virtually all Marian apparitions with skepticism but in certain cases they are either pushed from below by overwhelming popular support for the apparition which they feel they can’t resist without damaging their own legitimacy or else some people in the hierarchy decide that it would be advantageous to run with the ball and promote the apparition for their own purposes.

    However, it’s hard for me as an outsider to make sense of Normae Congregationis (or for the process of canonization in general) without being cynical because it combines elements of formal legal or scientific rigor with elements of magical thinking – e.g. that you can “prove” that X prayed to a saint or apparition and was “miraculously cured” AS A RESULT.

    She (i. e. the Church) merely states, after a long and detailed and very sceptical process, that the message attached to the apparition is not opposed to the faith and may (not must) be believed by the faithful. Or, contrarywise, She declares the message heretical or dangerous, condemns the apparition, and declare that faithful Catholics may not believe in either it or the message.
    One could deny each and every apparition “approved” by the Church and be in no way an unfaithful or unworthy Catholic.

But he is a real Catholic, who attends (as did Justice Scalia) the real Catholic Mass, that which was replaced by the artificial concoction of the “second worst pope in history” Pope Paul VI (one guess as to who is the worst). Since he has found no support either from Georgetown Prep, nor I would wager from his parish, it might just be that he will find himself attending the traditional Mass as Thomas’s guest. Most of you will have no idea why this might be of any importance, but I promise you all that it would make a new man of him (no more snivelling for one thing).

    Catholicism was once a bulwark of tradition in all its forms; today it is an effeminate enemy of all that is upstanding and proud. The New Mass, more than anything else, is the reason.

    You might have a look at Franz Werfel’s novel The Song of Bernadette. He was actually a Jew being pursued by the Nazis, but when he was hidden by townspeople in Lourdes, he promised to tell Bernadette’s story if his life was spared. He not only looked at official records, but interviewed people whose families had been in Lourdes for generations: their ancestors had actually known Bernadette.

    It is all a game, just like it was with the final McCain vote on Obamacare. When the ruling party is going to vote for something that will piss off a lot of people, even a large minority, they will finagle it down so that the smallest possible number of senators have to vote for the somewhat unpopular measure, and those who have the most to lose by voting for it will agonize and agonize down to the very last minute, and the party will reward them in some intangible way, like giving one of their staff a position on the Supreme Court, or overlooking their annual fact finding missions to Thailand, or in McCain’s case, he would be rewarded in the afterlife.

    For example when George W. Bush had to make a decision on allowing embryo cells to be used for stem cell research, he did not want to piss of religious fundies and right-to-lifers, so he fudged to the left, fudged to the right, offered up prayers to guide his decision, and then fudged a bit more by allowing existing lines to be used, but no creation of new ones.

    Result–a great one. By the time a year had gone by no one could really remember what George had allowed or disallowed, and everyone thought they had won, bar a few people on each side who actually knew what the issue was about, who were statistically insignificant.

    And even if they didn’t like it, the man had spent so much time on his knees praying about it, and even more time telling people about the praying, that you could hardly hold him personally responsible. It was in God’s hands. And since God practically invented the science of genetics single-handed (actually left-handed, since Jesus was sitting on his right hand at the time) you could hardly blame human beings for a spot of work on improving some aspects of the Creation where God seemed to have whiffed. It is the least man can do to return the favor for being created in the first place.

    And anyway, when the next president came along he could change the decision that no one remembered, which he did.

    This paragraph on the Van Dyke verdict is Orwellian, but I don’t think the writer is doing it on purpose. I think that English education has collapsed to the point where the writer would not see what they are doing wrong.

    He compared Van Dyke’s conviction to the narrative of the 2014 shooting of Michael Brown in Ferguson, Missouri. The unrest that followed the shooting left police unable to do their jobs as crime ran rampant through the city.

    The Ferguson Effect is not police overwhelmed by crime, but police restrained by paid outside agitators, criminally inept leaders, and judges who should be removed from the bench, who are all acting in the belief that it is law enforcement that is the problem, with the result that criminals run free. The use of the word “narrative” there appears to be completely meaningless: without specifying a narrative, the writer appears to use it as a synonym for “episode” or “story.”

    Notre Dame, from which Amy Coney Barrett was graduated, is #24 — no comment here on her suitability for the job, but at least she’s being seriously considered. Also in that decile: Cal-Irvine, Emory, Arizona State, Alabama, Iowa, and Wisconsin.

    There’s got to be somebody out there.

    His wife is English, so if he converted to Episcopalian, which is pretty much the same thing as Church of England, that is more a variation on the theme of catholicism, as the C of E is a historical splinter from the Church of Rome. One difference is that Anglican clergy can and do marry and have women priests. So not much difference theologically.

    Well, the 2A is an impediment. As is the 1A to some extent. To negotiate well you have to weigh what is important to cede or hold out for. Would you trade 1A or 2A for Roe v Wade? That is my main point.

    You may recall that Murkowski was primaried. She lost in 2010, only to win the general election as a write-in — a pretty impressive accomplishment. I agree with a previous poster that it’s a shame Sarah Palin didn’t run. Maybe this will be her chance, although Murkowski is not up until 2022 unfortunately.

    Lisa Murkowski has some strange political alliance with Indians (Eskimos?), who are something like 15% of the population. Alaskans love their fiercely independent culture almost as much as they love their big government.
