Colorado's rural counties are declaring one by one to refuse to uphold and enforce red flag laws, as well as any other new law coming from the state legislature that defies the US Constitution. The bill in question is HB19-11477, a “Red Flag” bill otherwise known as the Emergency Risk Protection Orders (ERPO) bill. More than half the state's counties have rebelled against it.
The red flag law that was proposed in Colorado is especially egregious, differing from reg flag bills in other states by making the case a civil matter, yet still resulting in gun confiscation. Besides being a direct violation of the 2nd, 4th, 5th, 6th, 7th, 8th, and 14th Amendments, it turns justice completely on its head by including an expansive list of family members, associates, and scorned lovers who are all eligible to petition the courts to confiscate your firearms.
HB19-11477 would actually even theoretically allow an ex-boyfriend with a restraining order against him to petition the courts to take a handgun away from an abused girlfriend, making it far easier and likely for him to commit an assault on her afterward. Think about that.
Fremont County started the recent wave on February 26th, when they passed a resolution in response to the red flag bill spurred in part by Sheriff Allen Cooper. He made the following statement at the time:
"It's our opinion that it does not offer enough due process to anyone who is targeted with an accusation of being, maybe, mentally incompetent or dangerous. I can not support this bill as it is currently written."
The movement has since then caught on like wildfire, reminiscent of similar movements in Illinois, Oregon, Washington, and New Mexico.
