Brian Peckford on Canada’s Charter of Rights and Freedoms

On this day 40 years ago I presented a written proposal to all First Ministers that several hours later became the Patriation Agreement which included the Charter of Rights and Freedoms.

It began the night before (Nov. 4) as a written proposal from the Newfoundland delegation to three Provinces in the Saskatchewan suite (Alberta and British Columbia plus of course Saskatchewan) of the Chateau Laurier Hotel.

At the November 5 breakfast meeting all first Ministers of the group of eight were present except Manitoba, but the Attorney General was present with instructions from his Premier. Quebec was present and had an opportunity to review the document. The proposal was accepted by seven Provinces with Quebec objecting. I was asked to present the proposal to full conference of all the First Ministers later that day .

The proposal became the Patriation Agreement later that day and the next year became known as the Constitution Act of 1982.

It was thought at the time that by putting the Charter of Rights and Freedoms in the Constitution, insulating it from the political machinations of Federal Legislation to which the 1960 Bill of Rights was subjected , that our Country would be secure in that its citizens were guaranteed of their rights and freedoms.

Today , we find that not even Constitutional Protection safeguards our rights and freedoms as Governments from St. John’s to Victoria plus the Territories run rough shod over our most sacred of documents.

Governments think some how that Section 1 protects them . But Section 1 says:

“1. The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society.”

Not one Government has even attempted to “demonstrably justify” their actions in this covid situation of lock downs, masks, mandates and vaccines, causing death and injury, suicide, depression, job loses and the loss of the most precious of ideas — hope.

It is somehow as if the Government speaks or acts it is automatically justified.

Hon. A. Brian Peckford P.C. Only living First Minister who helped craft The Constitution Act of 1982.

Brian Peckford will speak at the December 9 Nuremberg Doctors Trial 75th anniversary event at the BC Legislature , Thursday at 3:00 pm. Gathering starts at 2:00 pm. More information on pages 4, 5 and 6 in this edition of Common Ground.

  1. I did not know who you were until I watched your discussion with Reiner Fuellmich. Wow! So, glad I am learning about you…will be following you from now on. Thank you for explaining our government has been moving toward an executive system and thank you for fighting for our right to travel. God bless you!

  2. Justin Trudeau does not make my decisions, he does not make yours either, not with any provisions. But taking my rights, that means he has scores. But you are a citizen, that means he also has yours. Yet Nuremberg & our Charter will state something different, you can’t take our rights, that’s the guise of a Dictator. It’s a crime to inject anyone against their better judgement, through coercion and lies and out right subversion. They did that in Germany, with Tuskegee and far more. It’s been going on for decades, believe me, Fauzi keeps score. He tested AIDS drugs on orphans in the US & abroad. Little children without families. Do you need to know for what cause? That was the point though, they had no one to stand up, to say it was wrong and so treated them like smut. They will do it to you, if they are capable of hurting children. I’m not saying Trudeau knows this, but he should, he’s in charge of our civilization.

These are crimes against humanity, not a question about it, these people will pay, but how long before judgement? What will you put up with, not saying a word, not looking at facts, dismissing what you’ve heard.

I get it. It is hard, to accept the inevitable, that your Prime Minister is a traitor and has sold you to big chemicals. But nows not the time to live in upset. It’s the time to stand. Enough regret. We’ve been taken to long, for no more that a herb. They want to get rid of us, to stifle our objection, our dissent, our word. But that will not happen, the facts are clear, they will be prosecuted and witnessed in the public’s town square. We see it clearly, every misstep taken, by an over-inflated prime minister, for vanity and a UN Dictator. He will live to regret what he has partaken. To be a step stool for a dictator, is stupid and mistaken. He puts us down, acts like he’s better, we know the difference, he’s just a global misleader.

Stand Up Canada. We are one. We will remain that way, Trudeau has had his fun.

I questioned the pandemic and vaccine mandates from day one!
I was hoping for someone else to remind me and many others of our rights and freedoms and why they are being overridden!
This whole program is under the guise of the WEF and I am sick to my stomach that our current Government and leader is totally behind this.
We must stand up for our freedom now or we will loose it forever.

  4. Covid-19 and the various public health policies implemented to combat it must be one of the most reported topics in human history. The justification for these policy interventions, whether you agree with them or not, is well publicized and easily understood by anyone who cares to inform themselves. This opinion piece is all hot air and no substance.

  6. All the upper echelon of Canada Politics including our Military and Police are in denial of their duty and oaths if in fact they have sworn to one respecting our Canadian sovereign rights when it comes to the (Peckford Veritas of ) Charter Of Rights and Freedoms as was declared in 1982 by our Government to be enshrined in Our Constitution and guaranteed by our Constitution that we the people will have the Power to appeal to our courts if and when our constitutional Rights have been infringed upon or denied as has been the case (retroactively )for many years now and more importantly the past 2 years under the guise of a false narrative or to put it bluntly a lie. A lie of deceit, fearmongering, coercion to unlawfully use their Plandemic as a way to use cruel and unusual treatment to by-pass our Freedom of Rights and Constitution putting themselves in a position of treason and Murderous actions and outcomes by the illegal enforcement of the Canadian public to cruel and unusual treatment and death to mention a few. I by writing this declare I am of sound mind and ascribing to the Canadian Charter of Rights and Freedoms as my OUR defense tool in its entirety in condemning all said above as liable for all illegal and unlawful acts inscribed by all our Federal, Provincial and Territorial Governmental bodies and those holding parliamentary elected and un-elected positions as charged.
