Even though the City of Oberlin amended an ordinance banning guns in parks, their “fix” still violates state law, Ohioans for Concealed Carry charged yesterday in a membership and media advisory announcing a lawsuit against the city.
“Despite OFCC addressing council and telling them what they were about to do was illegal they proceeded anyway in a 4-3 vote,” the group’s president Jeff Garvas maintained in a press release announcement.
“An Ohio municipality that attempts to restrict firearms possession, transportation or transactions beyond state law violates Ohio Revised Code,” OFCC media contact Gary Witt explained in an accompanying press release. “This state law already has been challenged all the way to the Ohio Supreme Court and has been upheld in its entirety.
“OFCC previously asked Oberlin to repeal a city ordinance in conflict with ORC,” Witt elaborated. “Because Oberlin’s elected officials have failed to act reasonably and responsibly, OFCC now is seeking the aid of the courts to force Oberlin to comply fully with the Ohio Revised Code.”
Readers who also frequent this columnist’s The War on Guns blog and/or listen to the nationally-syndicated Armed American Radio program have been kept apprised of Oberlin’s continued obstruction of Ohio law. On Monday, Gun Rights Examiner exposed a scheme by the Oberlin Area League of Women Voters to recruit other Ohio chapters to overturn state firearms preemption under the guise of “home rule.” The hypocrisy of that stance was pointed out by documenting that when it comes to government enacting more restrictive edicts, the League demands imposing them everywhere, regardless of how the locals feel.

The “Complaint for Declaratory Judgment,” filed by OFCC and the “co-plaintiffs Brian and Janae Kuzawa, who originally contacted the Oberlin Police department about their park rules being in violation,” is linked to within the release.
