‘End of the road for the Orams’

THE BRITISH Supreme Court yesterday rejected a petition by British couple Linda and David Orams to file an appeal against the ruling of the British Court of Appeal in the case of Apostolides vs Orams.

In January, the British Court of Appeal ruled that the Orams must execute a judgment by a Cypriot court, which said that they must demolish the house they illegally built in the land of Greek Cypriot Meletis Apostolides in Lapithos.

Apostolides’ lawyer Constantis Candounas said yesterday’s decision was “the end of the road” for the Orams.

“We are very pleased and of course relieved because this is indeed the end of the road”, Candounas told the Cyprus News Agency.

Candounas said that the Orams have moved from the house they illegally built on Apostolides’ plot and have abandoned the property.

Bur he said they had not yet complied with the Court ruling to demolish the house and pay compensation to the legal owner.

“Since they have not yet paid any compensation, a decree was issued by the court which stipulates that property owned by the Orams in Britain is to be charged,” he added.

The British Court of Appeal ruled in January that a decision by a Cypriot court, in connection with claims relating to Greek Cypriot owned property in the north must be executed.

It's a pity that the legal systems and personnel in Cyprus don't support British nationals in the same way that the British Justice system supports GC's.

1.No title Deeds.

2. Developer recommended lawyers protecting Developers instead of their British clients who pay them.

3.Bank of Cyprus charging higher rates of mortgage interest to British mortgage Customers than their domestic Cypriot counterparts.

Over to you - Cypriot Legal System - lets see what you will do about these issues.

REALITY CHECK :

No expat with Title Deed problems gives a stuff about your petty tribalism.

If your lives have come down to nothing better than going over the past, you have no hope whatsoever of moving onto a bettwer futere.

That said, expats are stuck with the problem of Title Deeds / Ownership of the property they have paid for.

Expats must unite to get this problem moving and brought to a head.

This is a victory for no one. The TRNC will not return Oram's house to the claimants and neither will they knock it down.
It remains to be seen if there is any value to be seized in the UK, and the legal fees, out of proportion in any case, will remain unpaid as well. Good luck to the lawyers!

The Orams case has been nothing more than a diversion/camoflauge promoted by the Cypriot government to draw attention away from their own scandalous and probably (under at a minimum EU Human Rights law)illegal handling of the Title Deeds issue involving the human rights of literally tens of thousands of EU citizens, Russians and Cypriots.

The ROC's behaviour has condoned (by its inaction)and therefore encouraged and continues to encourage, the fraudulent behaviour of developers, the Banking system and certain members of the legal profession.

Lets not mince words, all of us are the VICTIMS of this gross negligence & incompetence by the ROC and the scandalous behaviour of the banks, develops and some members of the legal profession.

The Title Deeds scam must be made to be an issue that threatens the legal and political credibility of the EU itself, the major member countries in the EU and the Russian Federation.

Basically Cyprus is giving the finger to some of the major World powers and the largest economic/ political block on the planet.

There is not point in having a Human Rights Code in the EU (or any other laws for that matter)if the political organs of the EU do not defend and take action when the EU's laws are flouted and/or ignored by a member state.

Frankly, it makes the EU, the European Parliament and the other member states of the EU look like they are not responsive to the citizens of the EU and the politicians and bureaucrats are nothing more than a "chattering class".

ALL property purchasers that are financially and emotionally exposed to the Title Deeds scandal/fraud should commence a class action lawsuit in the ECHR and/or other independent Court of competent jurisdiction naming the ROC, ALL Cypriot Banks, ALL Cyriot Developers and the Cypriot Law Society (which seems incapable of actually controlling its members).

Although I have not discussed the above with CPAG, CPAG is a very credible, focused umbrella organisation that could be utilised to start the ball rolling.

They will need to find a lawyer willing to take on such an action and ALL victims of this scandal should join the class action law suit and supply sufficient funds to move forward.

I will definitely join such an action and I am willing to put a financial contribution for such an action.

IF YOU ARE NOT WILLING TO PUT YOUR MONEY WHERE YOUR MOUTH IS then stop blogging or writing to newspapers AS YOU ARE NOT SERIOUS ABOUT THE PROBLEM and you are just vewnting your own anger, only interested in your own "self interest" and you are not willing to take a part in a collective, srtrategic plan against the various Cypriot parties that are victimising you and thousands of others.

Turkish Cypriot land in the South of Cyprus is under Guardianship of the government who permit Greek Cypriot refugees to live in/work from property owned by Turkish Cypriots. These people know that they could be required to return the property at any time to its rightful owners.
That has already happened in some cases of Turkish Cypriots taking out ROC passports and returning to live in the south. The government has also paid for the full renovation of the Turkish Cypriot property in some certain cases where necessary.
Also whilst the Greek Cypriot refugees are using the Turkish Cypriot owned land they pay rent to the government who hold it in an account for the Turkish Cypriot owners.
This bears absolutely no resemblance with what has been happening with Greek Cypriot owned land in Turkish occupied north where Greek Cypriot owned land has been ‘given away’ by the illegal government with title deeds issued by the Turkish occupiers.

As for Turkish land which has been used for the airports etc, this is the same as any compulsory purchase of land for such uses and happens everywhere, even in the UK. The owners of the land will be compensated.

As far as ANYONE with any basic morals & principles is concerned, the Orams' got their comeuppance good & proper, and are now staring at financial ruin SOLELY because of their own stupidity & recklessness in buying disputed property on the cheap in an illegal, unrecognised breakaway statelet.

It's the equivalent of buying Palestinian-owned property in the West Bank from an Israeli (probably a settler at that!!). Now I must ask you: would anyone in their right mind even REMOTELY contemplate something as dodgy & as risky as that?!?! NO, OF COURSE NOT!!!!

All in all, a COMPLETE no-brainer if you ask me.

When it is they who have illegally invaded, Illegally killed 5,000 citizens, Illegally expelled 180,000 people from their own land/homes??
I know at least 10 T/c's who have returned to the south and were given their homes back.
I know that all T/c's are entitled to and obtain their pensions / healthcare/ in the south.
i know of at least 10,000 T/Cs who come to the south and work every day!!

When TCs want their land back, the RoC refuses or obtructs them from receiving what they are legally entitled to.

That's the problem Steve, RoC don't play fair when it comes to property/land.

Law of necessity cuts both ways and whoever has used the land must ensure they fully compensation the original owner. But TCs having to jump through zillion hurdles - one test case has already gone thru the ECHR highlighting this and prompting RoC to make changes. Another 9 TC cases will highlight these problems further and push RoC to sort its act out completely, just like ECHR has forced the North to do via its Property Commission....

Legally, any Turkish Cypriot land in the South is held in trust by the (Greek-Cypriot) Cyprus Government.

In regards Paphos Airport, if it were on land formerly owned by a Turkish Cypriot, the Government could invoke compulsory purchase, as happens in Britain, and would have happened had Heathrow got the third runway.

The Orams knew what they were doing, but the British Government should have done a lot more to protect British people by warning them of the legal pitfalls of acquiring property in the North.

ocassion to expropriate land for public use or necessary
infrastructure purposes. So if a small part had to be used then
as long as there is compensation for the owner (which in this
case I believe there is) then there is nothing unusual in this.

What did you expect the Govt of the ROC to do? They were hardly
in a position to use the airport in Nicosia were they???

It's a bit of a different scenario than buying land or property,
aware of the ownership issues & possible consequences, for you to live in. They contradicted themselves in court and were aware
that it was a gamble which they could and ultimately did lose.

Hopefully, given the more common sense driven Demopolous ruling of the ECHR, the Orams will be the first & last to have to experience this BS. That's why the Property commission has been set up in the North - current owners have rights too!

And it will be interesting how the ECHR deals with the Orams' own case against RoC/Mr Apostolides given the grossly unfair trial they experienced in the South Cyprus courts (as also proven by TC Nezire Sofi ECHR case). Even if the Orams can't reverse this case, once their case heard at ECHR, will surely help them recover their rights as innocent third parties then...
