Two California Judges Stall On Enforcing The Law
Summary: As San Francisco's renegade mayor continues to hand out marriage licenses to homosexual couples, two judges have refused to move quickly to stop the illegal process.

Judicial
tyranny can take many forms. In most cases, activist judges move quickly to
stop pro-family legal efforts by issuing injunctions against the enforcement of
laws as soon as they are passed. This happens most frequently in cases involving
parental notification laws or partial-birth abortion bans. Read TVC's report on

In California, however, two judges are using the opposite tactic: They're stalling
the legal process by refusing to act swiftly on a clear violation of state law
by San Francisco's renegade mayor, Gavin Newsom.
Newson began issuing marriage licenses to homosexual couples last week and more
than 2,400 have gotten licenses so far.
The Alliance Defense Fund is representing the Proposition 22 Legal Defense and
Education Fund, and the Liberty Counsel and Lively & Ackerman are representing
the Campaign For California Families. Both groups filed lawsuits to get this illegal
activity stopped and both groups have been rebuffed by two liberal judges. Judge
James L. Warren rejected the ADF petition because of a misplaced semi-colon. San
Francisco judge Ronald Quidachay has refused to block the homosexual marriage
licenses because he claims the court is not yet prepared to hear the case. He
may deal with the case on February 20.
Mayor Newsom's actions violate California's Proposition 22, which states that
marriage is only to be between one man and one woman. Newsom is also violating
California penal code 115, which "prohibits the knowing procurement of any
false or forged instrument to be filed or recorded in any public office."
This is a felony offense that can be punished by up to three years in prison.

story on February 19, 2004, indicates that the state of California is going to
reject all same-sex marriage licenses issued in San Francisco because city officials
altered official government documents to block out "bride" and "groom"
to substitute "applicant one" and "applicant two." According
to Nicole Kasabian Evans with the state Health and Human Services Department,
"If we receive application forms that are different from the single form
used throughout the state, we will not accept them."

Chicago's liberal Mayor Richard Daley has expressed support for homosexual marriage
and says he would have no problem with Cook County officials issuing same-sex
