The U.S. Navy has requested a permit from the (U.S. Department of Commerce, National Oceanic & Atmospheric Administration), National Marine Fisheries Service (NMFS), to "take" Marine Mammals in their Northwest Training & Testing Area (NWTT), between 2015 and 2020. These areas include, but are not limited to: Northern California, Oregon, Washington, Idaho & Alaska.
Public Comment is Due by July 17, 2015 According to the U.S. Federal Register:
"...NMFS has received a request from the U.S. Navy (Navy) for authorization to "take" marine mammals incidental to the training and testing activities conducted in the Northwest Training and Testing (NWTT) study area from November 2015 through November 2020. Pursuant to the Marine Mammal Protection Act (MMPA), NMFS is requesting comments on its proposal to issue regulations and subsequent Letters of Authorization (LOAs) to the Navy..."

Defined under the Marine Mammal Protection Act (MMPA) as "to harass, hunt, capture, or kill, or attempt to harass, hunt, capture, or kill any marine mammal" (16 U.S.C. 1362) and further defined by regulation (50 CFR 216.3) as "to harass, hunt, capture, collect, or kill, or attempt to harass, hunt, capture, collect, or kill any marine mammal. This includes, without limitation, any of the following:
- the collection of dead animals, or parts thereof
- the restraint or detention of a marine mammal, no matter how temporary
- tagging a marine mammal
- the negligent or intentional operation of an aircraft or vessel
- the doing of any other negligent or intentional act which results in disturbing or molesting a marine mammal
- feeding or attempting to feed a marine mammal in the wild"
- Defined under the Endangered Species Act (ESA) as "to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct."

U.S. Navy NWTT: "...Description of the Specified Activity The Navy is requesting authorization to take marine mammals incidental to conducting training and testing activities. The Navy has determined that sonar use and underwater detonations are the stressors most likely to result in impacts on marine mammals that could rise to the level of harassment..." Please note that the U.S. Navy has not issued their NWTT Final EIS/OEIS responding to all public comments received about their proposed Training & Testing activities in the NWTT Range and no "Record of Decision" has been signed by the Department of Defense. Thus, the Navy should wait until they have made a final decision on the type of "alternative" activities which they will approve for the the NWTT Range before asking NMFS for a permit to "take" marine mammals. According to the Navy on their website: "...The Navy is now reviewing the comments made and will address all of the comments in the Final EIS/OEIS, due to be released in summer 2015...All public comments received during the Draft EIS/OEIS comment period (January 24, 2014, through April 15, 2014) are still valid and are being considered in the Final EIS/OEIS for this action. No decision will be made to implement any "alternative" in the NWTT Study Area until the NEPA process is complete and a Record of Decision is signed by the DoN..."
Three alternatives are analyzed in this U.S. Navy Draft NWTT EIS/OEIS which is available for review online at links below:
• The No Action Alternative represents baseline training and testing activities as defined by existing Navy environmental planning documents, including the Northwest Training Range Complex EIS/OEIS, the Naval Undersea Warfare Center Keyport Range Complex Extension EIS/OEIS, and the Southeast Alaska Acoustic Measurement Facility EIS. The baseline testing activities also include other testing events that historically occur in the Study Area and have been subject to previous analysis pursuant to NEPA and EO 12114.
• Alternative 1 includes the training and testing activities addressed in the No Action Alternative, plus adjustments to types and levels of activities from the baseline as necessary to support current and planned Department of the Navy training and testing requirements.
• Alternative 2 includes all elements of Alternative 1 plus adjustments to tempo of activities. Training activities would generally remain the same as proposed under Alternative 1, while testing activities would increase, on average, about 12 percent over those in Alternative 1.

1) Contact State of Washington U.S. Senators & U.S. House Representatives - Requesting Congressional Hearings to Protect Our National Forests, National Marine Sanctuaries, Biologically Sensitive Areas, Marine Reserves, Coral Reefs & Other Coastal Regions from "Shock & Awe" Navy Warfare Testing.
2) Contact & Educate your local and state elected officials. They may not be aware of the issues facing our resources from U.S. Navy Warfare Testing & Experiments.
3) Educate the Media which includes local radio, newspaper, television, and other news sources with the story. Stick to the facts. When you write letters to the editor find out from them first how many words they allow in their letters for publication and then stick to that number. Also include information where the public can get additional information, correct public deadlines, and also links to public comment websites.
4) File public comments and questions in a timely manner before their deadlines. Questions work much better than just comments. When the U.S. Navy receives statements with just comments their response is "duly noted". When they receive questions they have to spend time answering your questions.

U.S. Navy Plans Electromagnetic War Games Over National Park and Forest in Washington State

On November 6, 2014, at a Public Meeting in Port Angeles, Washington, Dean Millett, Pacific District Ranger of the State of Washington Olympic National Forest, made the following statement when asked if the U.S. Forest Service had conducted independent research or studies prior to issuing a “no significant impact” draft notice of decision:
“…No, we have not conducted our own analysis…I believe that the Navy’s analysis sufficiently addresses that…We have not made a decision as this project yet. We are still in the comment collection process…” (It is alleged that legally the U.S. Forest Service must conduct independent impact investigations and cannot rely on other agencies as a basis for their decisions.)
We allege that Dean Millett will make the final decision shortly after the public comment period is over on November 28, 2014.
The U.S. Navy and the U.S. Forest Service also stated for the record on November 6, 2014, that Dean Millett had issued a "temporary permit" to the U.S. Navy to conduct Electronic Warfare activities within the last three years in the Olympic National Forest (exact dates, location, and scope unknown at this time.) It is alleged that the U.S. Navy and the U.S. Forest Service had not made this permit issuance public or referenced this temporary permit in the EW Range Draft Decision Notice Issued on September 13, 2014. Why?

Mendocino Coast Says NO to U.S. Navy Weapons Testing - March 7, 2014 - Fort Bragg, California
The Navy, in the above video, refused to answer any questions to this group as a whole attending the Navy Open House Meeting. The Navy would only answer questions individually at their individual Navy stations outside of the group meeting room. This restricted the ability of everyone attending their meeting to hear the answers to questions posed by the group as a whole. We allege that the U.S. Navy Open House process violates the National Environmental Quality Act (NEPA).
